3 <br />NE136-36-895631.v2 <br />may be levied or assessed upon Tenant’s property, the Leased Space, or any activity of Tenant. <br />Should it be determined that the interest of Tenant in this Lease is taxable, and should any tax be <br />levied, Tenant shall pay such tax. Upon request by Landlord, Tenant shall provide proof of such <br />payment. <br /> <br /> ARTICLE III - USE OF PREMISES <br /> <br />3.1 TENANT’S USE. During the term of this Lease, the Leased Space shall be used <br />solely for the purpose of offering Tenant’s services, which are defined as follows: day support <br />services for people with disabilities (“Rise Services”). <br /> <br />3.2 FITNESS MEMBERSHIPS. During the term of this Lease, Tenant will purchase <br />annual Community Center fitness memberships for its participants (“Memberships”). A total of <br />45 Memberships must be maintained by Tenant throughout the Term of this Lease. These <br />Memberships will be charged at the going rate of an annual resident family membership for a <br />family of 45. <br /> <br />3.3 COMPLIANCE WITH LAWS AND REGULATIONS. <br /> <br />(a) The parties will at all times during the term hereof maintain and conduct their <br />businesses insofar as the same relates to the occupancy of the Leased Space in such a manner and <br />under such regulations as to be in strict compliance with any and all applicable governmental laws, <br />rules, regulations, and orders <br /> <br />(b) The parties will comply with the applicable provisions of the Americans with <br />Disabilities Act (“ADA”). <br /> <br />3.4 AFFIRMATIVE COVENANTS OF TENANT. Without in any way limiting or <br />restricting other covenants of Tenant elsewhere in this Lease contained, Tenant affirmatively <br />covenants and agrees as follows: <br /> <br />(a) Tenant shall neither permit, suffer, or conduct activities that would constitute a <br />nuisance in, on or about said Leased Space or unreasonably interfere with any person <br />occupying the Community Center or the adjacent premises; <br /> <br />(b) Tenant shall keep the Leased Space, including all service and loading areas for <br />the Leased Space, free from all litter, dirt, debris, and obstructions; <br /> <br />(c) Tenant shall arrange for and accept deliveries only at such times, in the areas, <br />and through entrances designated for such purpose by Landlord; <br /> <br />(d) Tenant shall keep said Leased Space clean and in the sanitary condition required <br />by laws and regulations of any governmental or quasi-governmental unit having <br />jurisdiction; <br /> <br />(e) Tenant shall neither permit nor suffer the Leased Space, or the walls, ceilings, <br />or floors thereof to be endangered by overloading; and <br />
