<br />, <br /> <br />RESOLUTION NO. 93-080 <br /> <br />THE CITY OF NEW BRIGHTON, MINNESOTA <br /> <br />RESOLUTION AUTHORIZING ISSUANCE OF ORDER <br />TO ABATE NUISANCE <br /> <br />WHEREAS, Fred A. Rosenkranz is the record owner of property <br />located at 1521 14th Avenue NW, New Brighton, Minnesota (the <br />Subject Premises); and <br /> <br />WHEREAS, the Department of Community Development of the City <br />has received complaints concerning the maintenance of the Subject <br />Premises; and <br /> <br />WHEREAS, the City Sanitarian inspected the Subject Premises on <br />June 26, 1992, and found conditions constituting nuisances under <br />Chapter 17 of the City of New Brighton Code of Ordinances, <br />including the accumulation of brush, tir~s, lumber, metal, old <br />mowers and other rubbish, junk and trash, and the presence of a <br />substandard structure; and <br /> <br />./J!t; <br /> <br />WHEREAS, the City Sanitarian sent written notice dated June <br />26, 1992, (the June 26 Notice) by Certified Mail and regular mail <br />to Fred A. Rosenkranz at 1521 14th Avenue NW, New Brighton, MN <br />55112 on June 26, 1992, and posted a copy of said notice on the <br />property, which notice advised Mr. Rosenkranz of his violations <br />under Chapter 17 of the New Brighton Code of Ordinances and <br />informed him that he had 30 days in which to abate the violations; <br />and <br /> <br />WHEREAS, the substandard structure was subsequently removed, <br />but the remaining violations were not abated; and <br /> <br />WHEREAS, Mr. Rosenkranz sent the City a copy of the July 26 <br />Notice on which he had written a response including such statements <br />as: "At night people get shot in their homes and homes are burned <br />down!"; and <br /> <br />WHEREAS, the City currently is prosecuting Mr. Rosenkranz for <br />a misdemeanor violation and the trial on this criminal matter has <br />been continued to October 1993; and <br /> <br />WHEREAS, the City Sanitarian reinspected the Subject Premises <br />on June 10, 1993, and found an accumulation of rubbish, junk, <br />garbage, tree branches, cut trees, concrete blocks, full and empty <br />containers containing unknown liquid contents, and numerous other <br />items of rubbish, piles of old machinery, equipment, building <br />materials, and junked vehicles; the growth of noxious weeds; and <br />the presence of an unfilled excavation; and <br /> <br />WHEREAS, the City Sanitarian has determined that the condition <br />of the Subject Premises constitutes a nuisance under Chapter 17 of <br />
