<br />the New Brighton Code of Ordinances and is menace to the health of <br />inhabitants of the City and liable to cause injury; and <br /> <br />WHEREAS, the City Sanitarian reasonably believes that Mr. <br />Rosenkranz will not respond to another Inspection and Complaint <br />Report by abating the nuisances on the Subject Property. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City <br />of New Brighton, as follows: <br /> <br />1. That Fred A. Rosenkranz has maintained and used the <br />property located at 1521 14th Avenue NW, New Brighton, <br />Minnesota, (the Subject Premises) in such a way as to <br />permit: <br /> <br />(a) the accumulation of rubbish, junk, garbage, tree <br />branches, cut trees, concrete blocks, full and <br />empty containers containing unknown liquid <br />contents, and numerous other items of rubbish; <br /> <br />\. <br />(b) the piling, storing and keeping of old machinery, <br />equipment, building materials, wrecked or junked <br />vehicles and other junk or debris; <br /> <br />(c) the growth of noxious weeds; <br /> <br />(d) the existence of an unfilled excavation; <br /> <br />(e) other uses of said property which are deemed to be <br />a menace to the health of inhabitants of the city <br />and which are liable to cause injury. <br /> <br />2. That, pursuant to Section 17-2 of the New Brighton Code <br />of Ordinances, a public nuisance is being maintained and <br />exists on the subject Premises. <br /> <br />3. That, because of its inadequate maintenance, <br />dilapidation, physical damage and unsanitary condition, <br />the subject Premises constitutes a hazard to public <br />safety and health pursuant to Minnesota Statutes, Section <br />463.15 et seq. <br /> <br />4. That, pursuant to Section 17-7(b) of the New Brighton <br />Code of Ordinances, there is good reason to believe the <br />usual notice and prosecution procedure will be <br />ineffective in removing said nuisances. <br /> <br />5. That the City Council, by majority vote, hereby orders <br />the abatement of all nuisances existing on the Subject <br />Property and that an order in the form of Exhibit A <br />hereto (the Order) requiring the abatement of nuisances <br />existing on the Subject Property shall be issued and a <br />copy of the Order shall be served upon Fred A. Rosenkranz <br />and upon other record owners of the property, if any, and <br />
