<br />; <br /> <br />~ ..; <br /> <br />RESOLUTION NO. 93-063 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE <br />PERMIT TO ALLOW A CHURCH AND SCHOOL AND BUSINESS OFFICE USES TO <br />PROVIDE BY JOINT USE THE REQUIRED NUMBER OF PARKING SPACES <br />KNOWN AS SP-172B. <br /> <br />WHEREAS, an application for a Permit has been made by Church Upon the Rock; <br /> <br />and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a Permit was filed with the City of New Brighton on <br />November 25, 1992. <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on December 16, 1992, and January 19, 1993, all persons <br />present at the hearing were given an opportunity to be heard. <br />3. The City Council considered SP-172B at its January 26, 1993, March 9, <br />1993, and April 13, 1993, meetings. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following <br />Findings of Fact in respect to SP-172B: <br /> <br />1. The site is zoned B-3, General Business. <br />2. A proposed church and school and existing business offices propose to <br />comply with the total number of parking stalls required by the City's <br />Parking Ordinance through the joint use of existing off-street parking on <br />site. <br />3. Section 11-040 (e) of the City's Parking Ordinance grants the City Council <br />the authority to approve a joint parking arrangement through the special use <br />permit process. <br />4. The church and school propose to make joint-use of 33 parking stalls <br />designated for 6,000 square feet of business office use at the Rice Creek <br />Shopping Center (2100 Silver Lake Road). <br />5. The church would hold one service on Sunday morning between 9:00 a.m. <br />and 12:30 p.m. and would hold an educational gathering on Wednesday <br />evenings from 6:00 p.m. to 8:30 p.m. Neither of these gatherings would <br />conflict with the existing business office tenants hours of operation. <br />6. The church and school have a parking easement agreement over the 148 <br />parking stalls located adjacent to the north of the Rice Creek Shopping <br />Center site of which 116 stalls are designated for retail and business service I <br />uses which would leave a surplus of 32 stalls for use by the church and <br />school. <br />
