<br />~ <br /> <br />, '\ <br />" <br />\": <br /> <br />~. <br /> <br />RESOLUTION NO. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING PRELIMINARY PLAT <br />PL-198 AND PRO-55. <br /> <br />WHEREAS, an application for preliminary PRO-55 and preliminary PL-198 has been <br />made by Scottwood Corp.; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for PRO-55 and PL-198 was filed with the City of New <br />Brighton on October 30, 1992. <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on November 17, 1992, and all persons present at the hearing <br />were given an opportunity to be heard. <br />3. The City Council considered PL-198 and PRO-55 on November 24, 1992. <br />4. The City Council considered PL-198 and PRO-55 on December 8, 1992. <br /> <br />NOW, THEREFORE, BE IT RESOL VEO the City Council makes the following Findings of <br />Fact in respect to PRO-55 and PL-198: <br /> <br />5. The subject site is zoned R-2, Two Family Residential, and is currently under <br />consideration for a rezoning to R-1, Single Family Residential. <br />6. The subject site would need to be rezoned to R-1, Single Family Residential to <br />allow for the proposed Preliminary Plat and PRO. <br />7. The purpose of the PRO Ordinance is to encourage advances in housing <br />design and the development of the life-cycle environment. <br />8. The proposed development would appear to comply with the purpose of the <br />PRO Ordinance by targeting the "Empty Nester" market and offering homes <br />designed for that segment of the population. <br />9. If a development meets the purpose of the PRO Ordinance, the development <br />may be allowed flexibility in density and setback requirements. <br />10. A landscaped berm would be constructed along the south and southwest <br />property line to buffer the proposed single family homes from the existing <br />service station and railroad tracks. <br />11 . The proposed preliminary PRO and Preliminary Plat would comply with the R-1 <br />district/PRO standards and with the Chapter 26 Subdivision standards. <br /> <br />BE IT FURTHER RESOLVED, the application for PL-198 and PRO-55 is hereby granted <br />preliminary approval subject to the following conditions: <br /> <br />1 . Rice Creek Watershed District and City Engineer approval of the grading and <br />drainage plan. <br />2. MPCA approval of the Environmental Assessment. <br /> <br />Page 1 of 2 <br />
