<br />.I <br /> <br />RESOLUTION No. 05-062 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />SOLUTION MAKING FINDINGS OF FACT AND ApPROVING OF SP05-12. <br /> <br /> <br />REAS, an application for a Special Use Permit by Mounds View Independent School <br />District # 621 for a "food shelf' land use; and <br /> <br />EREAS, the procedural history of the application for a Special Use Permit is as <br />follows: <br /> <br />1. An application was filed with the City of New Brighton on June 28, 2005. <br />2. The Planning Commission, pursuant to published and mailed notices, held a <br />public hearing on July 19,2005, and all persons present at the hearing were <br />given an opportunity to be heard. <br />3. The City Council considered the request on July 26, 2005. <br /> <br />W, THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact <br />in respect to SP05-12: <br /> <br />1. The subject site is zoned R-l, Single Family Residential. <br />2. The School District has an approved special use permit to operate educational <br />programs. <br />3. The Council has reviewed and approved the use ofthe site for pre-kindergarten <br />programs and adult education programs. <br />4. The applicant is proposing to relocate the food shelf from Ralph Reeder facility <br />to the Pike Lake School site at 2101 14th Street NW. <br />5. "Food Shelf' is not a listed permitted use. <br />6. The City Council may consider other uses not listed in Section 4-030. <br />7. The application therefore requires a special use permit to be considered. <br />8. As specified in Section 8-130 of the New Brighton Zoning Ordinance, no <br />special use shall be recommended by the Planning Commission unless such <br />shall find: <br /> <br />a) That the establishment, maintenance, or operations of the special use <br />will not be detrimental to or endanger the public health, safety, morals, <br />comfort of general public. <br /> <br />b) That the special use will not be injurious to the use and enjoyment of <br />other property in the immediate vicinity for the purposes already <br />permitted, nor substantially diminish and impair property values within <br />the neighborhood. <br /> <br />c) That the establishment of the special use will not impede the normal and <br />orderly development and improvement of the surrounding property for <br />uses permitted in the district. <br /> <br />I:\COUNCIL\RESOLUTIONS\2005\Com Dev\SP05-12.doc <br />
