ApriI18,2006: The Planning Commission held a public hearing and recommended approval <br />on a 5-2 vote with revisions. The revisions included omission of the word "caterer" and <br />provided for a more broad use of food preparation by a third party. The two dissenting <br />commissioner's felt it was inappropriate to provide a means for commercial use of properties <br />in residential Zoning Districts. <br /> <br />Financial Impact: <br />None <br /> <br />Explanation: <br />The proposed amendment to establishes a set of standards whereby churches (or libraries, <br />museums, colleges, or schools) with commercial kitchens could lease or in some way permit <br />outside users access for preparation of food not associated with an event held at the church. The <br />proposed amendment creates a special use permit with six conditions relating to overnight <br />parking, signage, number of allowed employees, and hours of operation. Section 8-130, which is <br />the general special use permit conditions relating to general health, safety and welfare would <br />apply in addition to the six conditions established with this amendment. <br /> <br />Preparation of this amendment arose out of a local caterer who attempted to get a license to <br />operate out of Atonement Lutheran Church's kitchen. The Zoning Code currently doesn't allow <br />for such a commercial use in a residential zoning district.
