<br />PLANNING REpORT <br /> <br />ApPLICANT: <br /> <br />April 18, 2006 <br />ZA2006-005 <br />Zoning Code Amendment Related to Specially Permitted Uses in <br />Residentially Zoned Districts <br />City of New Brighton <br /> <br />DATE: <br />CASE: <br />SUBJECT: <br /> <br />REQUEST <br /> <br />Attached is a proposed amendment to Section 4-030, which is the established list of specially <br />permitted uses within all residential districts. This amendment would allow churches with <br />commercial kitchens to lease or permit outside users access for preparation of food not <br />associated with an event held at the church. The proposed language stipulates conformance with <br />six listed conditions, in addition to the general special use permit conditions listed in Section 8- <br />130. Any user attempting to operate out of a church (or library, museum, college or school) <br />under this ordinance would be required to appear before the Planning Commission and City <br />Council for review and approval of a Special Use Permit. As noted in condition #6, both the <br />property owner and business owner are required to be co-applicants. <br /> <br />Preparation of this ordinance amendment arose out of a local caterer who attempted to get a <br />license to operate at Atonement Lutheran Church, which is located on the southwest comer of <br />Silver Lake Road and Rice Creek Road. The Zoning Ordinance does not allow such a <br />commercial use in a property that is zoned for multi-family residential. The attached amendment <br />has been drafted after a clearer understanding of the extent of his proposed use of the church <br />kitchen and general Council support. The proposed language only allows preparation of food <br />and nothing more.
