<br />~ <br /> <br />" <br /> <br />RESOLUTION NO. 91 ~ 0 7 5 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE VN-284A. <br /> <br />; ~ <br /> <br />.1 <br />" <br />ii <br /> <br />~ : <br /> <br />WHEREAS, an application for a variance has been made by Norwest Bank; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a variance was filed with the City of New Brighton on June 28, 1991. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on July 16, 1991, and all persons present at the hearing were given an opportunity to be <br />heard. <br />3. The City Council reviewed the application for VN-284A on July 23, 1991. <br /> <br />NOW, THEREFORE, BE IT RESOLVED the City Council makes the following Findings of Fact in <br />respect to VN-284A: <br /> <br />.i <br /> <br /> <br />1. The subject property is zoned B-1, Limited Business. <br />2. According to Section 5-580 (bl, structures and paved areas in a Limited Business district <br />must be located at least 25 feet from an R-2, Two Family Residential district line, <br />3. The subject site abuts an R-2 district to the north. <br />4. The proposed drive-through and canopy would encroach up to 17 feet into the required 25 <br />foot setback area and would require a 17 foot setback variance. <br />5. The applicant is proposing to remove the existing overgrowth in the 25 foot wide buffer <br />area and install a six foot high brick wall, sod, and a generous amount of plantings and <br />trees to screen and buffer the proposed drive-through and off-street parking area from the <br />R-2 district to the north. <br />6. The distance between the closest residential structure and the proposed drive-through <br />retaining wall would be 100 feet, which is twice the distance possible through strict <br />enforcement of the Zoning Ordinance. <br />7. The subject site is triangular in shape and is bordered by public right-of-ways on two sides <br />and an R-2 district on the other resulting in increased setbacks and limited buildable area. <br />8.
