<br />~ <br /> <br />~ <br /> <br />~ <br /> <br />~ <br /> <br />CITY OF NEW BRIGHTON <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the <br />City Council of New Brighton, Minnesota was held on the 26th <br />day of March, 1991. The following members were present: <br />Benke, Gunderman, Larson. Rebe1ein. Williams <br />The following members were absent: None <br /> <br />Gunderman <br />moved its adoption: <br /> <br />introduced the following resolution and <br /> <br />RESOLUTION NO. <br /> <br />91-035 <br /> <br />AUTHORIZING CONDEMNATION PROCEEDINGS <br />FIFTH AVENUE N.W. WIDENING AND RECONSTRUCTION <br />CITY PROJECT NO. 89-13 <br /> <br />WHEREAS, the City of New Brighton has undertaken City <br />Project No. 89-13, which involves the reconstruction and widening <br />of Fifth Avenue N.W. between County Road E-2 and old Highway 8, <br />the installation of storm sewer facilities, and the construction <br />of a sidewalk adjacent to the reconstructed street; and <br /> <br />WHEREAS, in order to construct the improvements contemplated <br />by Project No. 89-13, the City requires certain permanent and <br />temporary easements; and <br /> <br />WHEREAS, the City Council finds it necessary, proper and <br />expedient in the interests of the public health, convenience and <br />general welfare of the citizens of the City of New Brighton for <br />the City to acquire said easements; and <br /> <br />WHEREAS, the City Council finds that the construction <br />schedule for proj ect No. 89-13 makes it necessary to acquire <br />title to and possession of said easements prior to the filing of <br />the final report of the condemnation commissioners to be appoint- <br />ed by the district court; and <br /> <br />WHEREAS, the use of Minn. Stat. Sec. 117.042 (1990), the so- <br />called "Quick-Take" statute, will enable the City to timely <br />acquire the required lands; and <br /> <br />WHEREAS, the City has ordered and received appraisal reports <br />setting forth the damages that will result due to the acquisition <br />of the easements; and <br /> <br />WHEREAS, the appraisal reports were prepared by a profes- <br />sional real estate appraiser, properly certified, who possesses <br />the appropriate appraisal credentials; and <br /> <br />WHEREAS, the apprai sal reports have been reviewed by City <br />staff, who state that the appraisal reports are in proper form <br />
