<br />.. <br /> <br />--....' <br /> <br />I~ <br /> <br />RESOLUTION NO. 90- 077 <br /> <br />;1 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION DETERMINING THE NECESSITY FOR THE ISSUANCE OF GENERAL OBLIGATION <br />BONDS AND CALLING FOR A SPECIAL ELECTION <br /> <br />NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of New <br />Brighton to hereby adopt the following: <br /> <br />1. The City Council hereby finds and determines: <br /> <br />a. That it is in the best interest of the health, welfare, and safety of I <br />the City and its residents that the City acquire, construct, furnish <br />and equip a municipal complex consisting of a community center <br />including a senior citizen activity area, teen lounge, leisure <br />pool, recreational facilities, and meeting/craftrooms; and <br /> <br />b. That the City is authorized by the provisions of Minnesota Statutes, <br />Chapter 475 to issue its obligations to finance the complex in whole <br />or in part and to pledge its full faith, credit and taxing powers to <br />the payment of such obligations; and <br /> <br />c. That it is necessary and expedient to the sound financial <br />management of the affairs of the City that the complex be financed in . <br />whole or in part by the issuance and sale of the City's general <br />obligation bonds pursuant to Minnesota Statutes in an amount not to <br />exceed $5,500.000 i and <br /> <br />d. That the City Council has approved the use of optical scan <br />electronic voting machines by the affirmative vote of two- <br />thirds of the members and has complied with the 60-day notice <br />and six week demonstration requirements of Minnesota Statutes, <br />Section 206.58, Subdivision 1; and <br /> <br />" <br /> <br />e. That in 1987 the County Auditor adopted a plan for use of the <br />optical scan electronic voting machines which has been <br />approved by the Secretary of State, and has certified to the <br />Secretary of State that an optical scan electronic voting <br />system will be used in the City and the date of commencement <br />of the use thereof. <br /> <br />2. The propositions for the issuance of the bonds will be submitted to <br />the voters of the City at a special election to be held on Tuesday, <br />November 6, 1990. The election will be held and conducted in <br />accordance with the laws of the State of Minnesota relating to special <br />municipal elections. <br /> <br />3. A notice of election in substantially the form attached hereto as <br />Exhibit A or sample hallot in substantially the form attached hereto <br />as Exhibit C, or both as the case may be, must be posted or published <br />by the City Clerk-Finance Director as follows: <br /> <br />a. Written notice must be given to the County Auditor at least <br />30 days prior to the election; and <br />
