<br />~ <br /> <br />1.04. The Council has determined that the Property is <br />currently underused and that acquisition is necessary to <br />enable the City to carry out the Development District <br />Program and to put the Property into productive use in its <br />highest and best use in a manner consistent with the <br />Development District objectives. <br /> <br />1.05. The Council has determined that it is necessary <br />to acquire the property by use of the power of Eminent <br />Domain as authorized by Minnesota Statutes, Chapter 117 and <br />Sections 469.124-.134, to establish clear title to the <br />Property as soon as possible so that the Property can be <br />redeveloped pursuant to the Development District objectives <br />and the Modified Development Program. <br /> <br />1.06. As of the date of the Resolution, the City has <br />been unable to complete the acquisition of the Property by <br />negotiation. <br /> <br />1.07. To carry out the purposes and objectives of <br />Minnesota Statutes, Sections 469.124-134, Development <br />District No.1, and the modified Development Program for <br />said District, it is necessary to proceed without delay <br />pursuant to Minnesota Statutes, Section 117.042, to acquire <br />title and possession to the real property described in <br />Attachment A hereto, prior to the award of the court- <br />
