ANY IN JULY 2001; THIS PLAN INCLUDES THE HOTEL, SENIOR <br />HOUSING, AND RESTAURANT ON THE EASTERN SIDE OF THE SITE. <br /> <br />3 Ayes - I Nay (Sweeley) I Ab~iained (L:1fSOn) <br /> <br />Considemtion of thc fCzoning of Johnson Screens' three vacant properties located east of Rush Lake and south of the <br />current building (1950 Old Hwy S NW). TIle Camp Plan calls for thc future land use ofthese parcels to be Mixed Use <br />(MX). MX correlates with the north gateway which will eventually be developed into an expanded main street to <br />include residential, commercial, and office uses. An industrial use such as the current opemtion will not be pennitted <br />in a MX. The Planning COlmnission recommended the rezoning. Johnson wants to protect their expansion ability, <br />but have no fi..lture plans at this time. The intent of rezoning would be to control the land use, but not to own the land. <br /> <br />Steve Dban, Johnson Screens, noted concern that rezoning without providing for grandfuthering would be detrimental <br />to Johnson Screens. Larson explained that Council supports any upgrades to the Johnson Screens facility, however, <br />this action provides protection in the event the parcels are sold to another use that may not be allowable within the MX <br />District. Dban requested 30 days to research this issuc of grandfathering, detailed planning outlines, and intended use <br />of the parcels. City Attomey CharI ie LeF evere explained that grandfathering is provided to an existing use, however, <br />the City ha<; the legal right to rezone the property to MX. <br /> <br />Motion by Moore-Sykes, seconded by Samuelson, to CONTINUE THE REZONING OF TIlE THREE <br />VACANT WTS OWNED BY JOHNSON SCREENS FROM 1-2, HEA VYINDUSTRIAL, TO MX, <br />MIXED USE, TO THE FEBRUARY 26, 2002, COUNCIL MEETING. <br /> <br />15 Ayes - 0 Nays, Motion Carried <br /> <br />- The City of New Brighton has detennined that a new Public Safety Facility should be constructed to provide more <br />efficient Police and Fire Response for the community. The City is actively acquiring properties south ofStl1 Street <br />between 4tl1 Avenue NW and Old Highway S to provide for the facility's construction. All of the properties to be <br />acquired are zoned R-l A, Single Family Residential, and must be rezoned to 8-4 to allow for the facility constmction. <br />Civic uses such as police and fire selVices can be considered and approved by the Council for an allowablc use in 8-4 <br />District. Staff is confident the number of proposed parking stans is adequate. <br /> <br />I <br /> <br />Motion by Hoffinan, seconded by, to WAIVE THE READING AND RECOMMEND APPROVAL TO THE <br />CITY COUNCIL GP 01-001, LP 01-014 AND RZ 01-005 SUBJECf TO COMPLIANCE WITH THE <br />FOLLOWING CONDmONS: <br />1. TIlE APPLICANT SHALL ADHERE STRICTLY TO THE RESTRICTIONS DETAILED ON <br />THE GENERAL DEVELOPMENT PLAN. <br />2. TIlE APPLICANT SHALL PROVIDE AN UPDATED LANDSCAPE PLAN wmrn SHALL <br />BE REVIEWED BY THE OTV FORESTER <br />3. TIlE APPLICANT MUST SUBMIT A LIGHTING PLAN SHOWING LUMEN LEVELS <br />ALONG THE EAST PROPERTY LINE. SAID ON-SITE LIGIITING SHALL NOT EXCEED.4 <br />FOOT CANDLES ALONG THE LINE. <br />4. ANY NEW UTILITY HOOK UPS SHALL BE DONE PER APPROVAL OF CITY ENGINEER <br />5. A PROOF OF PARKING SHALL BE DEVELOPED AND FILED WITH THE CITY TO <br />ADDRESS FUTURE PARKING DEMANDS. <br />6. A FINAL PLAT TO CONSOLIDATE AIL LOTS INTO ONE PARCEL AND VACATE <br />THE ALLEY; AND AN AMENDMENT TO THE COMPREHENSIVE PLAN TO <br />RECONCILE ZONING MAP WITH PLAN. <br />7.
