Sweeley noted concern of equipment noise, fencing, exhaust fumes, and gasoline sales. Smith explained <br />that by not selling gasoline or convenience items and shortening hours of operation, the effects on adjacent properties <br />will be reduced. As per Larson's comments the exhaust fan will be directed towards the front of the building. Smith <br />requested the hours of operation be extended by an hour to provide for cleanup, but no tool operation. Also, <br />employees will not be allowed to work on their on own cars, and they will try to limit noise during dinner time. Smith <br />would be open to providing a more aesthetic, closed dumpster. <br /> <br />Robert Malmquist, Brighton Square, said 12 town home decks face the property within 200 ft., and residents have <br />concerns regarding noisc levels. City Attorney Charlie LeFevere explained that if Smith's property was found to <br />exceed State standard decibel levels, then the City could revoke the Special Use Pennit. Moore-Sykes questioned if <br />the previous restaurant may have had this same type of noise for a longer period of time, if it difficult to anticipate <br />what the levels could be. Residents should contact the City if noise levels become excessive. <br /> <br />Barbara Jones, Brighton Square, feels tllls is not a goad use for tllis site because of the adjacent residential property, <br />and jeopardi7-e5 the property values. She questioned if the use could change over the yeMS. <br /> <br />Mickey Gotwald, Brighton Square, asked why docs a residential area be broken with a conunercial piece of property <br />put on the end of the block. Boylan explained that this zoning designation has existed for some time. <br /> <br />Brian Houwman, project architect, performed studies of decibel levels relating to impact wrenches, and fOlmd that <br />d(':Cibellevels do not increase due to the short time frame of the tool operation. To assist with exhau~t fumes, <br />I Houwman suggested directing tlle filtering sy,1em out towards the south side of the building to deter away from the <br />residential area. Mahnquist feels that equipment and m(':Chanical noises can be detrimental to healtll. Smith agreed to <br />keep the doors closed at all times. <br /> <br />Dave Sampson, Brighton Square, feels that the continual opening and closing of doors will allow noisc to escape. <br /> <br />Samuelson said the Planning Commission approved tlns proposal according to standards, but noted a need for some <br />type of sound barrier. Houwman believes that a sound engineer would need to be hired to obtain the SOLUld level in <br />compliance with stated conditions. <br /> <br />Sweeley suggested the monitoring of sound for a period of six months every two weeks to ensure that the property is <br />meeting standards. lfoffinan has some reservations of the City being expert or policing agent of the sound standards. <br />Larson asked if a baseline could be performed at this time. Kevin Locke, Community Development Director, <br />explained that the City docs not have sound monitoring equipment, but enforcing hours of operation, closing of doors, <br />and otller items relating to the operation could be sufficient.
