The City's property acquisition consultant has made <br />purchase offers to all seven properties and is ofthe opinion that all seven will be accepted. One of <br />the seven properties has been purchased at this time and one other has accepted the purchase offer, <br />but not closed. The remaining five property owner are considering their offcrs and appear to be very <br />IClose to accepting. Staff does not anticipate eminent domain, but it is standard procedure to <br />commence proceedings to ensure construction to begin March 31, 2002. <br /> <br />Sweeley mentioned concern that all affected property owners understand this process. Proper <br />explained there has been no hardship cases or elderly concerns identified, and statl'has provided <br />assistance and has done everything in a fair manner to resolve the situation. Moore-Sykes feels the <br />City has performed their utmost to assisting residents through this process. <br /> <br />Motion by Hoffman, seconded by Samuelson, to W ATVE THE READING AND ADOPT THE <br />RESOLUTION AUTHORIZING ACQUISITION OF PROPERTY BY EMINENT DOMAIN. <br /> <br />5 Ayes - 0 Nays, Motion Carried. <br /> <br />Consideration of Contract with EDS Consultants and construction management for construction of <br />the Public Safety Facility. As opposed to letting one contract to a general contractor, who will <br />employ many subcontractors to construct the facility, the construction manager utilizes a <br />professional to bid multiple contracts to construct the facility. The construction manager schedules <br />and controls the work like the general contractor, but works for and represents the City's interests, <br />whereas a general contractor's decisions would tend to be more profit motivated. The cost to use a <br />contract manager is less that the normal general contractor's markup for profit and overhead, so <br />there should also be an overall savings in the project cost. The agreement fee for the construction <br />management services for EDS Consultants and Construction Manager is $298,000. The fee does not <br />include professional liability insurance which would cost an additional $4,500 per year.
