However, he supports the request being that Jankowski is a long time resident and <br />the unique business would not exacerbate the parking situation greatly or be detrimental to <br />this property or adjacent properties. <br /> <br />Hoffman noted concern that any approval of the special use is tied to the parcel, and any <br />changes in its future use could worsen the existing problem. <br /> <br />Larson said ordinances are established for continuity of land use and zoning which affects <br />neighborhoods and businesses. Ordinance have to stand for what's best for the community <br />overall. Sweeley feels this is an individual decision and there would not be concern for <br />precedence or future uses. <br /> <br />Tom Waldren, building owner, does not want to burden the parking situation and is aware it <br />does not meet code, however, this use proposes limited parking usage. Moore-Sykes <br />understands Waldren's comments, however, the special use permit is not tied to the <br />individual but to the building. To grant a special permit would mean a future tenant could <br />store a greater number of vehicles without the requiring City approval. <br /> <br />Fulton suggested staff and the City Attorney research options to justify conditions to limit <br />parking. Locke suggested exploring the option of tying the special use pennit to the actual <br />lease conditions so that if the business did change the new owner would need to meet <br />conditions. Larson suggested that the application be continued to the June 12, 2001, <br />Council meeting. Larson believes the City needs to be confident that any decision stands <br />up to the court of law. <br /> <br />Motion by Moore-Sykes, seconded by Sweeley, to CONTINUE SPOI-05 AND NCOl-Ol <br />TO THE JUNE 12,2001, COUNCIL MEETING TO ALLOW STAFF, APPLICANT, <br />AND CITY ATTORNEY TO CONSIDER OPTIONS <br /> <br />5 Ayes - 0 Nays, Motion Carried. <br /> <br />SPOI-06 - Consideration of Special Use Permit for Beach's Long Lake Service at 2251 <br />Long Lake Road to construct an 1,830 sq. ft. addition to be used for work and storage. <br />This type of use is allowed within the B-3 District subjectto approval ofa Special Use <br />Permit. The expansion would not be detrimental and lot improvements will help contain <br />activity, noise and visual elements accompanying the proposal. <br /> <br />" <br /> <br />Motion by Hoffman, seconded by Samuelson to WAIVE THE READING AND ADOPT <br />THE RESOLUTION RECOMMENDING APPROVAL OF SPOI-06 SUBJECT TO <br />THE FOLLOWING CONDITIONS: <br />1. THE APPLICANT SHALL ADD CURBING TO THE SITE PLAN <br />DRAWING AND INSTALLED TO ALLOW WATER PENETRATION SO <br />AS TO MINIMIZE EROSION ON THE EAST AND SOUTHERN <br />PERIMETER OF THE LOT IF EXISTING CONDITIONS DO NOT <br />CONTROL EROSION. <br />2.
