<br />Assistant Director of Community Development-David Black introduced the 3rd
<br />order explaining the following conditions that need to be addressed.
<br />. Subsurface concrete removal at the Darling property.
<br />. Contaminated water at the Lange property.
<br />. Contaminated sediment at the Lange property.
<br />. Personal property removal at Killkenny property.
<br />. Removal of industrial drums at Kilkenny property.
<br />. Personal property removal at Beisswenger's
<br />. Asbestos removal at Beisswengers.
<br />

<br />Council Member Doffingquestioned how this particular situation fits the exception
<br />of the new legislative law relating to eminent domain practices.
<br />The City Manager, Matt Fulton explained this is a very complex situation, and the
<br />specific language was not known at the time. Mr. Fulton offered to provide the
<br />requested infonnation to the council at a future date.
<br />Council Member Doffmg requested an analysis provided by legal counsel as to how
<br />this fits the exception; in order to be sure we are not in violation of new eminent
<br />
