<br />1 <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />November 28, 2000 <br /> <br />Page 4 <br /> <br />Council Business. continued <br /> <br />Bob Kinney, 2933 Valerie Ln.,opposes the lot split for the reasons stated, and feels this is <br />a business decision which comes down to profit being made by means of the subdivision. <br /> <br />City Attorney Charlie LeFevere said variance denial would deprive the owner use ofthe <br />property as a single family home. It may not be the largest lot in the neighborhood but <br />there are others of similar size. Either decision of the Council is legally defensible, and <br />the Planning Commission did recommend approval with conditions. Moore-Sykes feels <br />the hardship is not found and the variance would be detrimental to the neighborhood. She <br />sees a beautiful lot which the owner could capitalize on that fact. <br /> <br />Motion by Gunderman, seconded by Moore-Sykes, RECOMMEND DENIAL OF PLOO- <br />8 AND VNOO-8 AND DIRECT STAFF TO PRESENT DOCUMENTATION TO <br />COUNCIL ON DECEMBER 11, 2000. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Locke presented special USe permit and site plan for Beisswenger's, 1360 Old Hwy 8, to <br />expand and reconfigure the existing parking lot with a 25 ft. setback from Old Hwy 8. <br />The rezoning to the MX District requires modifications be tied inclusion of landscaping <br />consistent with the Streetscape Plan. The Planning Commission recommended approval. <br /> <br />Moore-Sykes asked how this modification fits into the ultimate goal of redeveloping the <br />Corridor. Locke sees this as a temporary solution to determine if the improvement will be <br />performed before comprehensive plans are developed. The City Forester would assist in <br />the landscape design, and Beisswenger's intends to cooperate fully. <br /> <br />Motion by Moore-Sykes, seconded by Samuelson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION RECOMMENDING APPROVAL OF SPOO-16, <br />SUBJECT TO THE FOLLOWING CONDITIONS: <br />1. PERIMETER CURBING MUST BE INSTALLED AROUND THE OFF- <br />STREET PARKING AREA. <br />2. ALL OFF-STREET PARKING AND DRIVE AREAS BE PAVED WITH <br />BITUMINOUS SURFACE (WITH THE EXCEPTION OF THE SHARED <br />ACCESS AREA WITH THE BUSINESS TO THE SOUTH) <br />3. OFF STREET PARKING STALLS SHALL BE MARKED WITH WHITE <br />OR YELLOW PAINTED LINES NOT LESS THAN FOUR INCHES WIDE. <br />4. IN ORDER TO REDUCE FRONT YARD SETBACK FROM 30 FT. TO 25 <br />FT. APPLICANT SHALL BE RESPONSIBLE FOR INSTALLATION OF <br />ALL REQUIRED LANDSCAPING ALONG OLD HIGHWAY 8 TO BE <br />CONSISTENT WITH APPROVED LANDSCAPE/STREETSCAPE PLAN <br />TO BE COMPLETED BY A LANDSCAPE ARCHITECT. <br />5.
