Xcel Energy, explained that the agreement language is in place if the City <br />wishes to establish a fee in the future. <br /> <br />Jim Strommen, City Attorney, supports staff recommendation, and does not feel it is a <br />good use of City funds to continue negotiations with the gas and electric companies. <br /> <br />Dahms asked why the City did not ask the residents before beginning the agreement <br />negotiation process. Moore-Sykes said the City needed to perform due-diligence to be <br />bettcr prepared to answer community questions about the viability or interest in this fee. <br />Moore-Sykes bclieves the residents and business community were able to receive <br />information which was prudently spent to inform the community. <br /> <br />Fulton confirmed that the franchise agreement expired in 1998 due to the merger between <br />NSP and Xce1. The development and adoption of the ROW ordinance occurred in 1999. <br />Dahms would not wish to see another franchise fee presented next year in order to provide <br />for installation of street lighting. <br /> <br />Motion Moorc-Sykes, seconded by Samuelson, to DISCONTINUE THE CITY'S <br />EFFORTS IN NEGOTIATING GAS AND ELECTRIC FRANCHISE <br />AGREEMENTS WITH XCEL ENERGY RESULTING WITH THE REGULATION <br />OF XCEL ENERGY THROUGH THE CITY'S EXISTING RIGHTS-OF-WAY <br />ORDINANCE. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Proper presented a petition signed by 34 residents requesting the City install a street light <br />in the alley between 11th and 12th Ave. and 5th and 6th St. The location of th is street light <br />does not meet City policy and is in violation ofthe street light policy. Staff suggested the <br />petition and policy be forwarded to the Public Safety Commission for study. <br /> <br />Eunice Westby, Block Captain, said due to increased crime, night pedestrian and vehicle <br />traffic, the neighborhood is requesting action being taken in the interest of crime <br />prevention and safety. <br /> <br />Proper said the proposed light would be located on an existing pole which eliminates the <br />need to install a utility pole.
