The <br />Northwest Quadrant was identified in 1997 for future redevelopment, and the Old Hwy 8 <br />Corridor Study envisions a mixed use area with new housing to take advantage of the <br />regional park and Long Lake. In order to attract high quality redevelopment, it requires <br />the removal of blighted properties such as this 32-acre site. This property includes two <br />ongoing Superfund sites in various stages of remediation and unknown environmental <br />hazards. <br /> <br />The property owner has been aware of the City's future plans, and inquires have been met <br />with firm resistance. A letter was sent informing the owner of the City's intent, and staff <br />bcJieves the pressure of eminent domain will be necessary as background for negotiations. <br /> <br />Bob Lindahl, City Attorney, said the process would involve soil testing and property <br />appraisals. This filing is a necessary step and will provide a court order to proceed. <br /> <br />Motion by Gunderman, seconded by Samuelson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION AUTHORIZING CONDEMNATION OF THIS <br />PROPERTY FOR DEVELOPMENT PURPOSES. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Locke presented execution of a purchase agreement for the Canadian Pacific Railway <br />Property (TIF#26). The City has been pursuing acquisition oftwo 40 ft. wide strips of <br />land that pass through the Superfund site that encompasses both the Bell Pole and the <br />MacGillis and Gibbs pole yard. The strips ofland are owned by the Canadian Pacific <br />Railway and are adjacent to rail tracks. <br /> <br />Acquisition is needed to facilitate remediation of the property, and Canadian Pacific has <br />been unwiIling to consent to the pipeline relocation. An easement allowing Williams <br />pipeline to be located through these parcels will be brought before Council. The 40 ft. <br />strip is subject to the Bell Lumber month to month lease and base annual rent is $633.00. <br />Bell Lumber has proposed a five-year lease with three options to extend the term for two <br />years periods. The purchase price for the parcels is $36,000 and tenns of the agreement <br />provide Canadian Pacific a lOft. easement along the west edge and adjacent to the <br />railroad tracks. Closing is expected to occur before the end of this year. <br /> <br />Larson verified that the parcels are needed to provide for the relocation ofthe pipeline and <br />the remcdiation of the parcels. <br /> <br />Samuelson asked why isn't Williams Pipeline the entity to pay for the remediation.
