Prebonich had the right to build the detached accessary building. She feels <br />Prebonich was sorely misused by his neighbors which is evident by their unwillingness to <br />come together in agreement. The neighbors were notified of the variance, and the <br />mediation was not City sponsored but a suggestion by Council to come to a workable <br />resolution. She added that granting the variance was never a "done deal," and the New <br />Brighton Council has much integrity and would not operate in such a fashion. <br /> <br />Fuhr asked if the addition requires a change in utilities along the right of way. Teague <br />will investigate. <br /> <br />Samuelson thanked everyone for attending the meeting and their commitment to the <br />community. She felt Prebonich has been put in a very compromising position. <br /> <br />Motion by Samuelson, seconded by Hoffman, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING VN-006 SUBJECT TO THE <br />FOLLOWING CONDITION: <br />1. THE PROPOSED ADDITION MUST MATCH THE EXISTING HOUSE <br />MATERIALS INCLUDING COLOR AND THE ROOF LINE MUST ALSO <br />MATCH OR TIE INTO THE EXISTING ROOF LINE. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Teague presented a report on accessory buildings and accessory storage of boats, cars and <br />RV's with R-l District. In July, the Council formally received a petition regarding <br />accessory structureS and property maintenance issues. <br /> <br />Staff performed a survey of 10 cities which allow accessory buildings, and in general New <br />Brighton is more restrictive in terms of the number of buildings and maximum size <br />allowed. New Brighton allows a maximum of one building while all other cities allow <br />two or more buildings. New Brighton allows a 600 sq. ft. structure while other cities <br />allow up to or over 1,000 sq. ft. All ofthe cities allowed outside storage boats, and <br />recreational vehicles. New Brighton does not allow storage of cars, boats or RV's in a <br />rear yard. <br /> <br />Staff has not received any complaints regarding accessory buildings until the Prebonich <br />garage proposal. Over the past 2 years, 33 building permits have been issued for <br />accessory buildings and 16 ofthose were larger than 400 sq. ft. <br /> <br />Staff suggested that Council and the Planning Commission may consider an Ordinance <br />Amendment to require a special use permit for a detached accessory building in excess of <br />a certain size when an attached garage is present. Specific conditions could be placed <br />upon such structures such as building materials, screening and use. In regards to property <br />maintenance issues, staff does not see a need for Code changes.
