Report No. 06-121. <br /> <br />Assistant Director of Community Development-David Black introduced the 3rd change <br />order explaining the following conditions that need to be addressed. <br />. Subsurface concrete removal at the Darling property. <br />. Contaminated water at the Lange property. <br />. Contaminated sediment at the Lange property. <br />. Personal property removal at Killkenny property. <br />. Removal of industrial drums at Kilkenny property. <br />. Personal property removal at Beisswenger's property. <br />. Asbestos removal at Beisswengers. <br /> <br />The total increase is $29,156.00, less monies to be paid by Beisswengers. <br /> <br />lotion by Council Member Hoffman seconded by Council Member Burg to <br />pprove the attached change order #3 covering additional work by Wickenhauser <br />cavating on the Northwest Quadrant demolition project. <br /> <br />5 Ayes. 0 Nays, Motion Carried <br /> <br />2. Consideration of resolution authorizing and directing the <br />condemnation of 1255 Old Highway 8 NW. (post office) for <br />development pUI'JX>ses in the Northwest Quadrant. <br />Report No. 06-115. Resolution No. 06-042. <br /> <br />The Assistant Director of Community Development, David Black gave background <br />information on the property, offering a chronology of events including the City's <br />unsuccessful attempts to acquire the property. <br />Mr. Black outlined the impact associated with the Northwest Quadrant <br />Redevelopment project. <br />CmU1cil Member Doffmg questioned how this particular situation fits the exception <br />of the new legislative law relating to eminent domain practices. <br />~e City Manager, Matt Fulton explained this is a very complex situation, and the <br />pecific language was not known at the time. Mr. Fulton offered to provide the <br />equested information to the council at a future date. <br />Council Member Doffmg requested an analysis provided by legal counsel as to how <br />this fits the exception; in order to be sure we are not in violation of new eminent <br /> <br /> <br />vuncH Business <br />1.
