<br />----- <br /> <br />Ii <br /> <br />- ~ <br /> <br />~~,I,I <br />I <br />I <br /> <br />Ii <br /> <br />RESOLUTION NO. 88-_~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VARIANCE, VN-270 as <br />modified. <br /> <br />WHEREAS, an application for a variance has been made by James Stuart. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for variance was filed with the City of New Brighton <br />on September 30, 1988. <br />2. The Planning Commission, pursuant to published and mailed notices, <br />held a public hearing on October 18, 1988, and all persons present <br />at the hearing were given an opportunity to be heard. <br />3. On October 25, 1988, the City Council reviewed an application for <br />VN-270. <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council makes the following <br />Findings of Fact in respect to VN-270: <br /> <br />1. The subject property is zoned B-3, General Business. <br />2. The required side street year setback for parking lots in the B-3 <br />district is 15 feet. <br />3. The subject site is irregular in shape and bounded by public streets <br />on three sides. <br />4. Highway 88 to the east is a State Highway and consequently maintains <br />a large right-at-way. The distance from Highway 88 to the subject <br />site is approximately 80 feet. <br />5. Through the granting of setback variances in 1972 and 1987 for the <br />existing structure, the City Council has determined the unusual <br />characteristics of the subject site create an undue hardship and <br />unique circumstance. <br />6. The existing parking lot is setback 15 feet from the Highway 88 and <br />Long lake Road right-of-way. <br />7. The applicant's requested 15 foot ~etback variance along Long Lake <br />Road would allow paving up to the right-of-way line which could <br />severely diminish the green area along Long Lake Road and not be <br />keeping with the intent of the setback standards for parking lots in <br />the New Brighton Zoning Ordinance. <br />8. The proposed parking lot expansion as modified would require a 10 <br />foot setback variance from the Highway 88 right-of-way and a 6 foot <br />setback variance from the Long Lake Road right-of-way. <br />9. The proposed parking lot expansion as modified would provide for an <br />additional 36 parking stalls on site and allow for a reasonable use <br />of the subject site. <br />10. The green area along Highway 88 and Long Lake Road as proposed in <br />the modified plan would not be severely diminished. <br />11. The applicant has demonstrated unique and unusual circumstances and <br />an undue hardship. <br /> <br />'I <br /> <br />, <br />Ii <br />
