OF THE NEW
BRIGHTON ZONING ORDINANCE.

4 Ayes - 0 Nayes, Motion Carried.

Fulton presented the Right-of-Way Permit and Use Agreement with Metricom Inc.
Metricom proposes the use of a network of small, shoe box size radios located throughout
the City on about one-third of the utility poles or light standards. Internet subscribers
would be connected to these radios via a modem they purchase from Metricom and
connect to their computer. The Metricom internet service is faster than standard
telephone modems and would cost about $40 per month.

The permit and agreement will be in effect for nine years beginning on installation date,
and includes three/five-year renewal periods for a total of24 years. Metricom will pay the
City an annual fee equal to 1 % of adjusted gross revenue from subscriptions, $60/year for
each street light or utility pole utilized, up to $1,000 for legal fees associated with the
agreement, and ten free Metricom internet subscriptions for City business use. Assuming,
Metricom is able to get 2,000 subscribers, the annual fee would be $9,600.

City Attorney Charlie LeFevere reviewed the contract and found it suitable, however,
Brooklyn Center has a similar contract which contained items not included in the New
Brighton contract. Because of this, LeFevere suggested the contract be approved subject
to City Manager and City Attorney approval of those inclusions.

Moore.Sykes clarified that the City would receive up to 1 % of the adjusted gross value
which would not be dependent upon the $60 per year street pole fee.

Motion by Samuelson, seconded by Hoffman, to APPROVE THE RIGHT -OF - WAY
PERMIT AND FACILITY USE AGREEMENT WITH METRIC OM, INC.

4 Ayes - 0 Nayes, Motion Carried.

Counci I Business

Ordinance Amendment
Front Yard Structure
Setback
Report 00-053
Ordinance 667

ROW Permit and Use
Agreement with
Metricom
Report 00-041

Announcements and
Announcements and Updates Updates

Samuelson said the Ramsey County League of Local Governments will meet February 24.
