The property is located at <br />2200 Old Hwy 8 and is zoned I-I Light Industrial. The required setbacks have been met, <br />and the exterior will match the existing facility. Belair received a special use permit for a <br />grading and fill project and site plan approval in 1991. The site plan has been modified <br />slightly and involves some shifting oftrees and the weight scale location. <br /> <br />Samuelson is pleased to see the constmction of a permanent structure. <br /> <br />Motion by Hoffman, seconded by Moore-Sykes, to APPROVE LP-361, SUBJECT TO <br />COMPLIANCE WITH LP-259 AND SP-164 WHICH GRANTED ORIGINAL <br />APPROVAL OF THE BELAIR BUILDERS FACILITY. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Teague presented the zoning ordinance amendment for Section 4-040.C, 30 ft. Frontyard <br />Structure Setback Requirement for Residential Zoning Districts. This amendment is <br />considered due to an increase in requests for building entryway or porch additions onto <br />fronts of homes. In the past, these requests were denied because they did not meet the 30 <br />ft. setback requirement. <br /> <br />Staff conducted a survey and found that several older communities allow encroachments <br />under specific conditions. Roseville allows a 6 ft. encroachment into the required setback <br />subject to a special permit and conditions. Richfield allows a 10 ft. encroachment. <br />Bloomington allows entry way additions to encroach into the setback up to 24 ft. subject <br />to the entry way not exceeding 8 ft. in width. <br /> <br />Based on these findings, Staff suggests to allow an encroachment to go within the 30 ft. <br />setback by up to 6 ft. subject to approval of a special use permit and certain conditions. <br />Those conditions would be: addition uses the same exterior materials as the principal <br />structure, roof is properly proportioned and integrated with principal structure, the base of <br />the addition is not open and is consistent with the base ofthe building, and the structure <br />shall not exceed 35% of the width of the front excluding the garage or shall not exceed 12 <br />ft. in width, whichever is less. <br /> <br />Larson added there are numerous split entry homes in New Brighton, and the City does <br />not wish to deny residents from upgrading their property. This ordinance amendment <br />would allow more flexibility in those instances.
