<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />October 12, 1999 <br /> <br />Page 6 <br /> <br />Council Business. continued <br /> <br />Proper said the current process for handling utility repairs in the ROWs is very <br />informal, and the City does not charge for permit review. However, permits can lack <br />important information, surveys are not to scale, and sometimes permits are not <br />submitted. Our ROWs are valuable and need to be better managed, this ordinance will <br />set up procedures for permitting, fee schedules, timing, inspections, and standards for <br />repairing streets. He briefly explained the permit fees structure and the main <br />components of the draft ordinance: <br /> <br />1. The City would require a permit from ROW users, including telephone, cable, <br />electric/gas services, and public/private utilities. <br />2. Permits would be structured to ensure adequate information, full description of <br />excavation, degradation issues associated with loss of infrastructure, and <br />obstruction of traffic flow. <br />3. Provisions for recouping actual costs associated with the degradation of the <br />public infrastructure caused as a result of the work. <br />4. Permits administered by the City Engineering Department. <br />S. Ordinance provides City protection through bonds and insurance requirements. <br />6. Establishment of fees deemed appropriate. <br />7. Restoration of road areas to the condition, type, and age of area encroached. <br />8. Applicants provide mapping information to assure accurate record keeping. <br />9. Work done in the ROWs must be located and maintained underground. <br />10. Provisions for vacation of ROWs and user abandoned facilities. <br /> <br />Benke asked what consequences would be applied to a utility company if a permit was <br />not pulled. Proper feels the utility companies have too much invested in the ROWs, and <br />would adhere to City requirements. If a permit was not pulled, the City would <br />immediately cease work and require the property be returned to original state. This <br />ordinance does not pertain to contractors performing work on private water and sewer <br />lines. These contractors are required to apply for a water and sewer permit, and their <br />work is inspected by the Public Works Department. <br /> <br />Hoffman asked the process for implementation of the ordinance. Proper said the utility <br />companies are aware the ordinance is forthcoming, and staff will schedule an <br />informational meeting with utility staff. <br /> <br />Fulton confirmed that formal adoption of the ordinance will occur October 26. <br /> <br />Announcements and Updates <br /> <br />Applications are being accepted for the Intergenerational Task Force. <br /> <br />Samuelson thanked the Park and Recreation Commission for all their work on the park <br />component of the Comprehensive Plan. <br /> <br />Samuelson said residents have expressed concern of traffic speeds near Silver Lk. Rd. <br />and 14th Ave. She asked if traffic calming methods could be developed by the Public <br />Safety Commission. Benke noted the need for a second speed trailer, and suggested <br />research in funding opportunities. Fulton said the trailer was donated by New Brighton <br />service organizations and a new trailer would cost about $15,000.
