D <br />and Cleveland Ave, The request is to reduce the side street yard setback from 30 ft. to <br />15 ft. to reconfigure the parking lot. The proposed reconfiguration would increase the <br />number of parking spaces from 75 to 79 by providing 4 disability parking stalls. <br /> <br />The landscaping plan remains with the exception of two additional spruce trees. There <br />is a sewer manhole on the northwest corner which the City accesses several times a <br />year. A 10 ft. utility easement would be dedicated along the western property line, and <br />the City would need to pave this easement to allow for truck access to the manhole, <br /> <br />Keith McDonald, applicant, requested deferral of the easement at this time, Kevin <br />Locke, Community Development Director, does not believe subsequent discussions <br />would affect whether the easement is needed or how it is performed. Benke noted the <br />MNDOT I-35W easement adjacent to the proposed easement, and asked if the City could <br />negotiate a freeway right-of-way easement. Teague verified this easement is in place, <br />but the Public Works Department cannot access through the fence with their trucks, and <br />the truck weight demands pavement surfacing, Samuelson asked if landscaping will be <br />affected by the easement. Teague said the trees and landscaping will not be affected, <br /> <br />Motion by Gunderman, seconded by Larson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING SP-216, SUBJECT TO COMPLIANCE <br />WITH THE FOLLOWING CONDITIONS: <br />1. AT LEAST FOUR OFF STREET PARKING STALLS MUST BE <br />PROVIDED FOR HANDICAP PARKING, ONE OF WHICH MUST BE <br />VAN ACCESSIBLE. <br />2. DEDICATION OF A to-FOOT UTILITY EASEMENT ALONG THE <br />WESTERN PROPERTY LINE FOR THE PURPOSE OF <br />CONSTRUCTION OF A PA VEn PATH TO PROVIDE ACCESS TO A <br />MANHOLE IN THE NORTHWEST CORNER OF THE LOT. <br />3.
