LeFevere said submittal of a grading plan by the potential buyer detailing <br />information would suffice. <br /> <br />Motion by Gunderman, seconded by Samuelson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION APPROVING PL-255, SUBJECT TO <br />COMPLIANCE WITH THE FOLLOWING CONDITIONS: <br />1. A GRADING AND DRAINAGE PLAN MUST BE SUBMITTED WITH A <br />BUILDING PERMIT APPLICATION TO ENSURE THAT ANY <br />GRADING ASSOCIATED WITH THE CONSTRUCTION OF THE NEW <br />HOME SHALL NOT HAVE ANY NEGATIVE IMPACTS ON ADJACENT <br />PROPERTIES. <br />2. SUBMITTAL OF $750 FOR PARK DEDICATION FEES FOR THE <br />CONSTRUCTION OF THE NEW HOME ON PARCEL B. SAID FEES <br />SHALL BE DUE AT THE TIME OF BUILDING PERMIT <br />APPLICATION. <br />3. SUBMITTAL OF A DRAINAGE AND GRADING PLAN WHICH WILL <br />REQUIRE THE APPROVAL OF THE CITY ENGINEER, AND <br />SUBSEQUENT GRADING AND DRAINAGE PLAN WITH ANY <br />BUILDING PERMIT APPLICATION. <br /> <br />5 Ayes - 0 Nayes, Motion Carried, <br /> <br />Teague presented a request for a 1.13 foot front yard setback variance to construct a 11- <br />x-3.79 foot entry way on the front of a home located at 2046 Mississippi Circle, The <br />applicants, Keith and Kristine Tussing, feel the location of the home makes it impossible <br />to construct an entry way without this variance, The Planning Commission feels that <br />adding an entry way is a reasonable use of the property, and the addition would be <br />beneficial to the neighborhood, <br /> <br />Staff feels if the City denied the variance, it does not preclude reasonable use of the <br />property, Despite the smallness of the variance, it does set a precedence for similar <br />request, and staff would recommend denial of the variance, The Planning Commission <br />(Vote 4-2) recommended approval of the variance. <br /> <br />Larson added that the Planning Commission felt it was difficult to make modifications to <br />older homes while complying with setbacks. It seems this is not a substantial <br />infringement on the 30 ft. setback requirement, and six neighbors did sign a petition <br />supporting the entry way, <br /> <br />Samuelson feels the new design provides a positive update to the neighborhood. <br /> <br />Benke said there are many homes of similar design, and the City should encourage <br />upgrades to housing stock, however, staff comments are of great value.
