<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />August 10, 1999 <br /> <br />Page 4 <br /> <br />Public HearinE. continued <br /> <br />Motion by Samuelson, seco(1ded by Gunderman, to DELAY ACTION ON PL-254, <br />MINOR SUBDIVISION AND ALLEY VACATION REQUEST, TO THE AUGUST <br />24, 1999, COUNCIL MEETING. <br /> <br />5 Ayes - 0 Nayes, Motion Carried, <br /> <br />City Engineer Les Proper presented the feasibility study for Drain Tile Installation on <br />North Pike Lake Court, Project 99-09. A petition was initiated by five residents of N. <br />Pike Lk. Ct. requesting action to eliminate sump pump discharge from 1370 N. Pike Lk. <br />Ct. This sump pump runs continually during the summer since the home was built four <br />years ago. The continual flow of water results in a green slime growth in the curb gutter <br />which the residents feel is a health hazard and liability problem for slipping and falling. <br /> <br />The City inspected the water services and found no indication of leaking, and the source <br />was identified to be groundwater. The suggestions provided in the petition are not <br />feasible. The drain tile cannot be connected to the sanitary sewer, and discharging <br />further onto the lot would create surface flooding, After consultation with the City <br />Attorney, staff recommends resolving the issue through the public improvement process <br />which allows the City to correct the problem and special assess costs to benefitting <br />properties, The project would involve installation of drain tile from the sump pump <br />discharge pipe to the 14th St. storm sewer. The drain tile would be installed on the <br />boulevard and tunneled under the three driveways and 14th St. sidewalk. <br /> <br />The total project cost would be $5,500, and of that $1,500 would be assessed against <br />1370 N. Pike Lk, Ct. The remaining would be assessed against the 14 lots on Pike Lk. <br />Ct. at $142.86/10t, and the City's portion would be $2,000, Because 1370 N, Pike Lk, <br />Ct. receives most benefit, it is felt they should bear a greater portion of the assessment. <br /> <br />Benke noted the property owner's responsibility, and asked if the Nuisance Ordinance <br />could apply in this case. LeFevere said the Nuisance Ordinance may allow civil action <br />against the property, however, it could become more costly than the improvements, <br />Proper said one option is to apply a larger portion of the assessment to the benefitting <br />property. Benke suggested an alternative which the City pays engineering costs from the <br />Stormwater Utility Fund and assessing any remainder to the benefitting property, <br /> <br />Fulton added this project was proposed by the neighbors and not the benefitting <br />property. He visited the site and found it to be dry, but an area to the immediate north <br />was very wet. Drainage from this cul-de-sac may be coming from a variety of sources. <br />If the City allows neighbors to petition, it places the burden on the affected property, <br />and puts the City in a difficult situation, This is a small project, but will take time away <br />from more pressing projects. While the property owner should accept a larger portion, <br />it may need to be shared, Larson feels the other properties should not be subjected to <br />expenses if it were determined they did not contribute to the problem, <br /> <br />Scott Jorgensen, 1389 N, Pike Lk_ Ct., said during the recent street reconstruction, <br />work was delayed because of drainage associated with that property. Special equipment <br />was brought to the site to dry the street to prepare for paving, He installed a drainage <br />system to address problems on his property, but this system operates during a short <br />period during rainfalls.
