<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />June 22, 1999 <br /> <br />Page 5 <br /> <br />Council Business. continued <br /> <br />Peter Hilger, project architect, believes the applicant has been diligent in addressing <br />property owner concerns, The applicant would agree to the ten outlined conditions, but <br />vigorously opposes a condition stating the 10:00 p,m. closure, He noted the Super <br />America across the street is a 24-hour operation, and typically video rental activity <br />lessens after 9:30 p.m. The applicant proposing a landscape berm to provide screening <br />from any lighting originating from the site, Once this site is developed, any drainage <br />currently flowing to adjacent properties would be reduced by 80 % . <br /> <br />Daniel Tyson, MGM attorney, believes the hours of operation limitation is not feasible <br />given the nature of the business and market competition, The applicant is willing to <br />amend the hours by a closure at or before midnight on Friday and Saturday evenings, <br />and 11 :00 p,m, on week nights, Samuelson asked if customer visits lessen after 10:00 <br />p.m. and asked if the applicant is willing to change those hours. Tyson cannot commit <br />without contacting the applicant, but feels the applicant is willing to identify solutions, <br /> <br />Larson said the applicant stated that 80 % of business occurs Thursday, Friday, and <br />Saturday between 4:00- 8:00 p.m, Tyson confirmed that the remaining 20% of activity <br />provides for the success of the business, Hoffman asked if the store would have a drive- <br />up window. Tyson said the video drop box would be located near the front door, <br /> <br />Jim Tri, 2443 Mounds Ave., lives directly north of the site and has endured property <br />damage associated with current drainage conditions. He believes this project will only <br />exacerbate the problem, and suggested a berm around the rear of the site to prevent <br />flowage into adjacent properties, He opposes hours later than 10:00 p.m" and prefers a <br />use such as a professional office building, Hilger feels this project is a substantial <br />improvement over what exists today, and the landscape plan retains mature deciduous <br />trees which would provide screening. <br /> <br />Bill Pickering, 2407 Mounds Ave., echoed Tri's concern regarding drainage and hours <br />of operation, Previously, he was informed by staff that future use of this site would <br />most likely be B-1, typically a professional office building. He suggested construction <br />of a 5-inch berm at the end of Mounds Ave. to detour drainage, and asked if fencing <br />could be installed around the east to prevent trespassing into adjacent properties, <br /> <br />Darren Lazan, Landforms Engineering, said the proposal provides for an 80% reduction <br />in current runoff rates, Removing the remaining 20% is impossible due to grading <br />problems associated with the northeast corner. Also, the existing berms at Mounds Ave. <br />would prevent the drainage from crossing over. Hilger said the drainage would flow to <br />the parking lot and eventually drain to outlets on Silver Lk, Rd. This proposal provides <br />a substantial mitigation of 80 % less drainage than existing conditions. <br /> <br />Due to ever changing technology which may affect the video business, Benke feels the <br />City should initiate rezoning of this parcel to B-1 to provide for future usage. <br /> <br />Council Business <br /> <br />Hollywood Video Site <br />Plan <br />Report 99-147 <br />Resolution 99-058 <br />
