Larson asked if one of the new residents <br />intents to use their garage as a workshop, Schell has no knowledge of this workshop. <br /> <br />One resident stated no objection to the shared driveway and 14th S1. access. <br /> <br />The City Engineer reviewed and approved the grading and drainage plan, but would <br />require individual grading plans for the homes constructed on Lots Band C. <br /> <br />Motion by Larson, seconded by Hoffman, to WAIVE THE READING AND ADOPT <br />THE RESOLUTION APPROVING PL-252 SUBJECT TO COMPLIANCE WITH <br />THE FOLLOWING CONDITIONS: <br /> <br />1. <br /> <br />A GRADING AND DRAINAGE PLAN MUST BE SUBMITTED WITH A <br />BUILDING PERMIT APPLICATION TO ENSURE THAT ANY <br />GRADING ASSOCIATED WITH THE CONSTRUCTION OF THE TWO <br />HOMES SHALL NOT HAVE ANY NEGATIVE IMPACTS ON <br />ADJACENT PROPERTIES. <br />THERE SHALL BE NO BUILDING ENCROACHMENT INTO THE <br />DRAINAGE EASEMENT. <br />SHARED DRIVEWAY ACCESS SHALL BE OFF SILVER LK. RD. <br />THE APPLICANT SHALL WORK WITH THE CITY'S ENGINEERING <br />DEPARTMENT IN REGARD TO UTILITY HOOKUPS. <br />A TWENTY -FOOT UTILITY EASEMENT SHALL BE CENTERED <br />OVER SEWER LINE COMING IN OFF OF 14TH ST. <br />SUBMITTAL OF A SHARED DRIVEWAY ACCESS <br />EASEMENT/AGREEMENT THAT WOULD HOLD THE LOT OWNERS <br />OF LOT B AND C RESPONSIBLE FOR MAINTENANCE. SAID <br />AGREEMENT SHALL BE SUBJECT TO REVIEW AND APPROVAL OF <br />THE CITY ATTORNEY. <br />PARK DEDICATION OF $750/LOT FOR EACH OF TWO NEW LOTS <br />SHALL BE PAID AT TIME OF BUILDING PERMIT APPLICATION. <br /> <br />2. <br /> <br />3. <br />4. <br /> <br />5. <br /> <br />6. <br /> <br />7. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Teague presented a request for a 26.5 f1. front yard setback variance to construct a 26 x <br />22 ft. detached garage at 575 2nd Ave. NW. <br /> <br />The applicant currently has a one stall attached garage, and wishes to construct a <br />detached garage off 2nd Ave, adjacent to the driveway, Staff found no other location on <br />this site to construct the garage without a variance which requires identification of <br />unique circumstances and undue hardship, Variance findings may be made in this <br />situation due to the unique pie shaped lot, overhead power lines, and lot location <br />between two streets containing 30 f1. setback requirements. Staff and the Planning <br />Commission believe a 7 f1. setback is in character with the neighborhood, and would not <br />be detrimental to adjacent properties or public. <br /> <br />Benke noted portions of adjacent land residing in the 1-35W ROW currently owned by <br />the State.
