NW. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />Motion by Samuelson, seconded by Hoffman, to CONTINUE CONSIDERATION OF <br />1998 ANNUAL FIRE RELIEF ASSOCIATION REPORT TO APRIL 13,1999. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />City Planner Cary Teague presented a site plan review, non-conforming use permit and <br />side street setback variance to install a drive-through window and expand the Dairy <br />Queen at 409 Old Hwy 8 NW. The nonconforming use permit relates to the existing <br />off-street parking setback not being met. Dairy Queen proposes to expand the setback <br />from 8 ft. to 16 ft., and install significant green space and green space island to separate <br />the drive-through from existing parking. <br /> <br />The drive-through will encroach 3 ft. onto the setback thus requiring a 3 ft. variance. <br />The site contains a 40 ft. restrictive setback requirement, and staff has not found other <br />areas which would meet the setback. Because of this, the Planning Commission and <br />staff recommend approval subject to conditions. Larson added the revised drive-through <br />reconfiguration allows for six vehicle stacking. Greg Arnold, Dairy Queen, feels recent <br />modifications provide for a workable situation. <br /> <br />Motion by Larson, seconded by Hoffman, to WAIVE THE READING AND ADOPT <br />THE RESOLUTIONS APPROVING LP-353, NC-114, AND VN-322, SUBJECT TO <br />COMPLIANCE WITH THE FOLLOWING CONDITIONS: <br />1. OFF-STREET PARKING STALLS MUST BE STRIPED WITH WHITE <br />OR YELLOW PAINTED LINES, NO LESS THAN FOUR INCHES WIDE. <br />2. THE LANDSCAPING PLANS SHALL BE INSTALLED PER SUBMITTED <br />PLANS, WITH THE EXCEPTION OF REPLACING THE PIGMY <br />CRIMSON BARBERRY WITH FIVE ANTHONY WATER SPIREA. <br />3. INST ALLA TION OF A UTILITY SINK AND DRY STORAGE AREA PER <br />THE REGULATIONS OF THE CITY'S HEALTH INSPECTOR. <br />4.
