Gas sales are allowable in B-3 and MX districts. <br /> <br />Motion by Samuelson, seconded by Hoffman, to WAIVE THE READING AND <br />ADOPT THE ORDINANCE AMENDMENT TO SECTION 5-140 WHICH <br />ELIMINATES GASOLINE AND ICE SALES AS A USE ALLOWED BY SPECIAL <br />PERMIT IN THE B-2 ZONING DISTRICT. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Teague presented a site plan review for US West to amend the landscape plan for the <br />telecommunications monopole and parking lot on 390 Cleveland Ave. The monopole <br />was constructed in 1997, but staff found the landscaping was not installed. Rather than <br />install landscaping, US West proposes installation of 6 ft. high fencing to provide <br />security and screening. The City Forester reviewed and amended the plan to include a <br />second row of juniper trees on the east side of the fence. Larson said the landscape <br />changes satisfy any concerns expressed by the Planning Commission. Pat Conlon, US <br />West, said this facility would eventually provide all needed telephone and Internet access <br />to New Brighton and Arden Hills. <br /> <br />Motion by Larson, seconded by Samuelson, to APPROVAL OF LP-346, SUBJECT <br />TO THE FOLLOWING CONDITIONS: <br />1. AN ANTI-CLIMB WOOD FENCE BE INSTALLED, AND MAINTAINED <br />AROUND THE BASE OF THE MONOPOLE AND EQUIPMENT PAD <br />FOR SECURITY PURPOSES. <br />2. THE PROPOSED JUNIPERS ON THE NORTH AND EAST SIDE OF THE <br />FENCE AND MONOPOLE SHOULD BE PLANTED AT 5-6 FEET TALL <br />TO PROVIDE AN IMMEDIATE SCREEN. <br />3. THE REMAINDER OF THE LANDSCAPING SHALL BE INSTALLED <br />PER THE SUBMITTED LANDSCAPE PLAN DATED OCTOBER 22, <br />1998, WITH THE ELIMINATION OF THE BLACK SPRUCE TO BE <br />REPLACED WITH JUNIPER TREES. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />City Attorney Charlie LeFevere presented the Release of the Sanitary Sewer Easement <br />and Satisfaction of Mortgage on the Village Center Project. In connection with Village <br />Center's refinancing, a few title defects involving City interests were discovered. A <br />sanitary sewer easement had inadvertently been missed when the property was sold. <br />Staff performed research and found the utilities were private so the City has no reason to <br />retain the easement, and recommends release.
