CONSIDERATION OF APPROVAL TO WAIVE THE READING AND <br />ADOPT THE RESOLUTION DECLARING COSTS TO BE ASSESSED, <br />ORDERING PREPARATION OF PROPOSED ASSESSMENTS, AND <br />SCHEDULING THE SPECIAL ASSESSMENT HEARINGS ON PROJECT <br />97-1,98-6, AND 98-7 FOR SEPTEMBER 22, 1998, AT 7:30 P.M. <br /> <br />3. <br /> <br />CONSIDERATION OF APPROVAL OF EXEMPTION FROM LAWFUL <br />GAMBLING LICENSE FOR THE NEW BRIGHTON EAGLES <br />AUXILIARY #3718 FOR OCTOBER 10, 1998. <br /> <br />4. <br /> <br />CONSIDERATION OF APPROVAL OF THE FIRST AMENDMENT TO <br />THE AMENDED AND RESTATED REGULATORY AGREEMENT <br />PERTAINING TO THE REFINANCING OF THE BRIGHTONDALE <br />ASSISTED LIVING PROJECT. <br /> <br />5 Ayes - 0 Nayes, Motion Carried <br /> <br />Public Hearing - None <br /> <br />Council Business <br /> <br />City Manager Matthew Fulton presented a petition from Silver Oak Park residents <br />opposing installation of two tennis courts which Council authorized in May. The <br />petition reflects disagreement within the neighborhood of the type of capital park <br />improvements to install. It is recommended that Council receive the petition and direct <br />staff to work with the neighborhood to resolve the issue. <br /> <br />Samuelson believes the issue merits further investigation. <br /> <br />Gunderman is sympathetic, however, Council approved and promised these courts many <br />years ago and would not recommend revisiting the issue. <br /> <br />John Angelucci, 301 Oakwood Dr., noted the changes in the neighborhood since the <br />original park plan was proposed. He feels the question is how to best suit the park's <br />purpose for the neighborhood, and most do not want the courts. Also, many residents <br />were not notified of previous discussions regarding the courts. <br /> <br />Deborah Hanson, 365 Oakwood Dr., walked door to door, and found only three people <br />who showed interest in the courts. The majority have children or grandchildren who use <br />the park for soccer and baseball, and feel it would be a shame to remove an open space <br />and replace it with occasionally used courts. <br /> <br />Benke acknowledged a decision had been made, however, the substantial number of <br />signatures commands some type of dialogue. <br /> <br />Dave Swenson, 1693-3rd St., remembers when the courts were originally proposed 18 <br />years ago, and the residents fought with the developer to donate park land. He does not <br />believe there is need for additional play areas when there are currently soccer and <br />baseball fields, a sliding hill, and other play areas.
