<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />August 25, 1998 <br /> <br />Page 3 <br /> <br />Council Business. continued <br /> <br />Motion by Samuelson, seconded by Larson, to RECEIVE THE PETITION FROM <br />SILVER OAKS PARK NEIGHBORHOOD ON THE PROPOSED TENNIS <br />COURT INSTALLATIONS AND DIRECT STAFF TO WORK WITH THE <br />RESIDENTS IN AN ATTEMPT TO RESOLVE TmS ISSUE AND RETURN AT <br />THE EARLIEST TIME POSSIBLE WITH A RECOMMENDATION. <br /> <br />4 Ayes - 1 Naye (Gunderman), Motion Carried. <br /> <br />City Planner Cary Teague presented a request from the City of Minneapolis for an <br />amendment to the Special Use Permit for the Water Works Reservoir. The request is to <br />haul and store 70,000 cubic yards of fill for on-site storage over a period of 24-30 <br />months. Minneapolis feels on-site storage would reduce the impact of daily trips which <br />would involve 67 continuous days of hauling equating to 61 truck trips per day. <br /> <br />The location of the stockpile site is on the north side of a "barrow pit" adjacent to the <br />Wexford Heights residential development. New Brighton approved a plan in 1997 for <br />Minneapolis to use on-site soils within this barrow pit thereby reducing hauling by 75 %. <br />However, now the contractor has fill available from other projects to bring to the site for <br />future use. Minneapolis proposes construction of an 8-inch pipe to drain the barrow pit <br />away from adjacent properties. Whether Council approves or denies the request, the <br />grades and slopes will be returned. <br /> <br />The Planning Commission reviewed the request and recommended denial based on the <br />negative impact to adjacent properties resulting from stockpile dust and construction <br />equipment noise. Teague noted that no Minneapolis representatives were in attendance. <br /> <br />Samuelson asked how the conditions would be enforced. Teague said New Brighton <br />expects Minneapolis to follow the conditions, and if not, New Brighton will conduct <br />periodic inspections. Samuelson asked if the impact of dust and noise were the reasons <br />for Planning Commission denial. Benke had received numerous complaints from <br />residents regarding truck noise. Larson added that some residents stated the activity has <br />caused cracks in their foundation walls. <br /> <br />Hoffman asked if Teague discussed this proposal with Columbia Heights. Teague said <br />Columbia Heights favors the proposal mainly because it will reduce the number of truck <br />trips and the storage area is not located near Columbia Heights properties. Benke <br />questioned whether it is easier to monitor activities over a 60-day period versus 2 1/2 <br />years. Larson feels the reason for this latest proposal is the contractor was able to locate <br />additional fill which would become available over a two year period. <br /> <br />Gary Halverson, 260 Wyndham Cir., said the project has affected adjacent properties <br />greatly by removing mature trees, installing steel fencing, dust and noise, ground <br />shaking, and truck traffic. This proposal is put forth in the disguise of reducing truck <br />traffic when in reality the contractor and Minneapolis have not lived up to obligations. <br />He did note that New Brighton has been very supportive during this difficult time. <br /> <br />Bill Thomas, 230 Wyndham Cir., believes Minneapolis deviated from the agreement <br />when they removed trees, began a mining operation, and stockpiled fill along Stinson. <br />His home's non-bearing walls have cracked from vibrations, and he feels Minneapolis <br />should pay and provide for daily on-site inspections and neighborhood impact statement. <br /> <br />Council Business <br /> <br />Silver Oak Park <br />Tennis Courts <br />Report 98-171 <br /> <br />Special Use Permit <br />Mpls Reservoir <br />Project <br />Report 98-172 <br />Resolution 98-080 <br />
