CONSIDERATION OF APPROVAL TO AUTHORIZE THE MAYOR AND <br />CITY MANGER TO EXECUTE A PURCHASE AGREEMENT FOR THE <br />ACQUISITION OF PROPERTY OWNED BY THE CANADIAN PACIFIC <br />RAILWAY ADJACENT TO THE WEST PROPERTY LINE OF THE <br />FORMER MACGILLIS AND GIBBS PROPERTY. <br /> <br />4 Ayes - 0 Nayes, Motion Carried <br /> <br />Public Hearing - None <br /> <br />Council Business <br /> <br />City Planner Cary Teague presented the final plat approval for a nine single family <br />residential lot development named Stony Lake Estates. All lots meet minimum lot <br />standards, and a drainage and utility easement was established over Lot 1 and the <br />identified Stony Lake wetland. An error which was previously uncovered in the Lot 9 <br />grading plan has been corrected. The Planning Commission reviewed the plat and <br />recommended approval subject to the conditions of approval. <br /> <br />The City Forester examined the two trees on the east side of Lot 9 and found them to be <br />healthy. The proposed 36 ft. setback would allow for the trees to remain, and still <br />provide sufficient building area. The City Forester reviewed the boulevard landscape <br />plan, and recommended the evergreen trees be replaced with Pink Spire. Also, <br />plantings of Hackberry, Birch, or Norway Maples were recommended along the ROW. <br /> <br />Benke asked if the tree preservation plan and the landscape recommendations have been <br />shared with adjacent property owners. Teague said the neighbors have reviewed and are <br />confident with the City Forester's recommendations. However, there was one question <br />regarding the two trees residing in the road ROW. <br /> <br />Samuelson confirmed that the street will be constructed at the 28 ft. width. <br /> <br />Kay Banister Schaffer, 1650 - 23rd Ave., noted concern of damage to trees and fencing <br />during construction, and asked who would be accountable for their replacement. She <br />asked that a number of trees be preserved along her property line, and if the construction <br />crew could move the boulder residing in the ROW onto her property. She confirmed <br />that the White Oaks are found four ft. into the ROW, and asked if these could remain. <br />She expressed Ron Meilahn, 1638 - 23rd Ave., concerns regarding Lot 9 which include <br />the garage location and tree preservation. City Engineer Les Proper stated he was <br />unaware the White Oaks were located within the ROW. <br /> <br />Benke said the objective is to retain as many trees as possible and reduce the <br />development's impact to adjacent properties. He asked if vacation of any portion of the <br />northern ROW could be considered. Proper does not feel vacating the ROW is <br />appropriate because of issues relating to street accessibility and maintenance.
