Minar's existing parking areas do not meet setback code requirements and <br />a non-conforming use permit is required. Teague feels given the access change and that <br />Minar has not submitted formal plans, it would be better to look at an overall site plan of <br />both areas rather than just act on the McDonald's proposal. <br /> <br />Benke feels the McDonald's proposal is worthy, however, there are timing and site <br />issues which have not been resolved with Minar. Teague believes the two projects <br />should be reviewed simultaneously. The lot split and new driveway would remove an <br />area currently used for new vehicle storage, and this change may exacerbate current <br />parking problems along Service Dr. <br /> <br />Benke questioned that if Minar intends to abandon the Service Dr. would neighborhood <br />traffic then travel from 27th Ave. to Palmer Dr. Teague said the vacation would allow <br />for employee parking and new vehicle storage which would eliminate on-street parking <br />problems. Benke asked if property owners to the west have been notified of the <br />proposal. Teague received some feedback from adjacent properties, but not from <br />property owners in affected areas. <br /> <br />Tom Drews, McDonald's, explained that ultimately they wish to begin construction after <br />Labor Day, and any delay could greatly impact them. Benke stated that approving the <br />McDonald's proposal locks the City into a presumption of agreement for the <br />abandonment of Service Dr. This agreement would significantly impact the adjacent <br />neighborhood which has not been notified of this proposal. <br /> <br />Ken Shacklen, McDonald's, is anxious to begin construction, and encouraged <br />consideration of their proposal as stand alone with no connection to Minar. <br /> <br />Samuelson asked what improvements will be made to the new facility. Drews said the <br />building's size will be increased by 1,000 sq. ft, and drive thru modifications will <br />provide better accessibility. <br /> <br />Larson is pleased with the McDonald's proposal, but noted concern that the Police and <br />Fire Departments have not reviewed the access routes. <br /> <br />David Phillips, Ford Architect, said the northside access is not tied to the Service Dr. <br />vacation, but Minar prefers it remain if the vacation did not occur. He said MNDOT <br />and City representatives suggested the Service Dr. vacation and Palmer Dr. access. <br />Benke said any changes impacting the neighborhood would need to be supported and <br />reflected in a traffic study. <br /> <br />Phillips said Minar would hate to see the McDonald's project delayed, and expects to <br />come before Council with a comprehensive site plan within the next few weeks. Benke <br />believes the Palmer Dr. access, as shown on the McDonald's plan, would be an <br />assumption given by Minar for access to their parcel. Phillips said the benefits of the <br />access outweigh the loss of parking spaces which will be recouped through the vacation. <br />Minar intends to renovate the building even if the Service Dr. is not vacated, and the <br />land swap is contingent upon the approval of the driveway access. <br /> <br />Council Business <br /> <br />McDonald's Site Plan <br />Report 98-156 <br />
