Phillips said the <br />renovation involves parking and building modifications, and the renovation's nature <br />hinges on acquisition of the Service Dr. Samuelson asked if Minar has contacted the <br />nursing home located to the west. Phillips has not contacted the nursing home because <br />the plans are somewhat premature, but assured there will be meaningful discussions. <br /> <br />Benke asked if approval of the McDonald's plan imparts the presumption of the <br />driveway which would directly impact the neighborhood. LeFevere suggested if Council <br />approved the McDonald's proposal, a covenant could be applied stating Minar would not <br />use the driveway until all necessary approvals are secured. However, this assumes the <br />site plan, non-conforming use, and special use permits are approved. Fulton said the <br />subdivision needs to occur in order for McDonald's to move forward, and questioned if <br />Minar could push their schedule so to accommodate McDonald's. <br /> <br />Benke prefers to see the broader implications of the Minar site before approving the <br />McDonald's proposal. Drews said the latest the project could be delayed is October 1. <br />Phillips asked if the McDonald's proposal could be approved and the new driveway <br />constructed before Minar begins renovation. <br /> <br />Benke acknowledged Phillips and Drews concerns, but reiterated the need for public <br />input on the proposal. Approving a new access at this time, predisposes and sets a <br />course of action that Council mayor may not want to follow. Phillips noted that <br />MNDOT came to Minar suggesting the closure of the Service Dr., but the changes are <br />not predicated on the closure. Benke noted Council's apprehensive in charging ahead <br />without reviewing the broader ramifications created by these requests. Samuelson <br />agrees that the neighborhood should be contacted. <br /> <br />Drews understands Council's dilemma, and feels the reconstruction will only help to <br />remedy current traffic and site problems. Benke noted the broader question relates to <br />the relocation of traffic and possible impacts to the neighborhood. <br /> <br />LeFevere asked for clarification of Minar's delay in processing the proposal. Phillips <br />said it is difficult to begin site planning until the perimeters are established, however, a <br />preliminary plan with/without the Service Dr. could be available in two weeks. <br />LeFevere suggested a proposal which includes the access and minimal site changes. <br />Phillips said a draft could become available in a few days. <br /> <br />Fulton said the Minar proposal needs to be reviewed by the Planning Commission and <br />then presented to Council on August 25. Drews confirmed the schedule would be <br />acceptable, and would like to submit building plans immediately following approval. <br />Teague confirmed the July 2nd application date. LeFevere said any extension actions <br />would be considered later. <br /> <br />Motion by Larson, seconded by Samuelson, to CONTINUE CONSIDERATION OF <br />LP-343 AND PL-247, SITE PLAN AND MINOR SUBDIVISION FOR <br />MCDONALD'S TO AUGUST 25, 1998, AND DIRECT STAFF TO CONTINUE <br />COMMUNICATION WITH APPLICANTS, PLANNING COMMISSION, AND <br />THE IMPACTED NEIGHBORHOOD. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />McDonald's Site Plan <br />Report 98-156 <br />
