Hoffman confirmed that the City Forester will <br />investigate the condition of the Oaks and determine whether they are worth saving. <br /> <br />Council determined that Condition #5 (homes must meet the City's minimum setback <br />requirements), be eliminated due to its redundancy. <br /> <br />Motion by Samuelson, seconded by Larson, to WAIVE THE READING AND ADOPT <br />THE RESOLUTION APPROVING PL-246, SUBJECT TO THE FOLLOWING <br />CONDITIONS: <br /> <br />1. <br />2. <br /> <br />3. <br /> <br />4. <br /> <br />5. <br />6. <br /> <br />7. <br />8. <br /> <br />9. <br /> <br />10. <br /> <br />Approval of a permit by the Rice Creek Watershed District (RCWD). <br />The proposed roadway must be constructed to a 28-foot wide paved surface with <br />a 42-foot paved radius for the cul-de-sac. <br />The mature White Oaks along the eastern lot line are not disturbed, and a <br />minimum setback for driveways and all structures be 40 feet from the east <br />property line for Lot 9. The proposed home on Lot 9 would have to be shifted 10 <br />feet to the east. <br />The 26-inch diameter Oak Tree on Lot 7 be saved, and be fenced during <br />construction of the home on Lot 7 to protect it from damage. <br />Each new home must be constructed above the 932 elevation. <br />The Final Plat must include a drainage and utility easement over the drainage area <br />on Lot I, and over the Stony Lake Wetland. <br />Review and approval of the Final Grading Plan by the City Engineer. <br />Installation of a storm sewer overflow in 23rd Avenue to protect lakeshore <br />properties from flooding. <br />Each new home proposed for construction within the subdivision must submit a <br />grading plan with their application for a building permit. Said grading plans must <br />be consistent with the overall grading plan approved as part of the Final Plat. <br />The proposed cul-de-sac be named 16th Terrace Northwest, and be designated as <br />such on the Final Plat. <br />The developer shall be responsible to dedicate fees in lieu of land for Park <br />Dedication in the amount of $750 per lot, fees shall be due at the time of Building <br />Permit application. <br />The Council makes the finding that an Environmental Assessment Worksheet is <br />not required as part of this project. <br />A Boulevard Landscape Plan shall be submitted with the Final Plat application. <br />Said Plan shall be subject to review and approval of the City Forester. <br />Covenants shall be established on each lot within Stony Lake Estates requiring <br />that two (2) two-inch diameter trees be planted on each lot. <br />CoVenants shall be established on each lot within Stony Lake Estates prohibiting <br />any alteration of the grading and drainage without review and approval of the <br />City Engineer. <br />City Forester shall work with developer on saving individual trees during <br />construction. <br /> <br />11. <br /> <br />12. <br /> <br />13. <br /> <br />14. <br /> <br />15. <br /> <br />16. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />Preliminary Plat for <br />Stony Lake Addition - <br />PL-246 <br />Report 98-148 <br />Resolution 98-071 <br />Resolution 98-072 <br />
