The <br />installation of the pipe allows for drainage to flow into the storm sewer and into the <br />sedimentation pond. He would not recommend filling the low area adjacent to Lot 1 <br />because it could push drainage over to neighboring properties. <br /> <br />Benke asked if there is value in extending the culvert to Lot 8 and 9. Proper feels the <br />grading plan does not exacerbate flooding, and allows for drainage between lots. Plow <br />said the pipe would allow drainage to leave the area quickly. Benke said the pipe may <br />help, but asked if it could be extended to the east. Proper said extending the pipe would <br />require grading on existing properties. Benke prefers to provide existing residents with <br />some comfort level, and feels this option should remain open. Schaffer noted concern of <br />costs associated with drainage corrections. Proper noted the area contains a drainage <br />easement. Benke said any improvement costs would be discussed at a later date. <br /> <br />Proper would not recommend any traffic control devices at the intersection of 16th Terr. <br />and 23rd Ave. It is a fact that uncontrolled intersections with low traffic volumes are the <br />safest. An uncontrolled intersection allows for each individual to approach the <br />intersection with the anticipation to stop. Benke added that the location of an overhead <br />street light will be installed at the 16th Terr. and 23rd Ave. intersection. <br /> <br />Tom Benahrio, 2391 - 17th St., said his property is graded lower than Lot 4, and has <br />concern future owners could terrace the backyard in a way to create a flooding hazard to <br />his property. He requested a covenant be applied to that parcel restricting regrading or <br />terracing of the backyard. Benke noted less concern of the initial construction grading, <br />and more concern of future excavation. Teague said a condition could be added stating <br />the grades would remain consistent with the final grading plan. <br /> <br />Fulton confirmed that a condition stating the City Forester's final approval of the <br />landscape plan would be added. Teague said the condition could state that the applicant <br />must submit a boulevard landscape plan subject to City Forester approval. Plow said <br />they could require that the developer plant trees of specific size along the boulevard and <br />ROW per City Forester request. <br /> <br />Fulton noted the expectation that covenants be established relating to Benahrio's grading <br />concerns, boulevard landscape plantings, and tree preservation along Lot 9. Such <br />covenants shall be established subject to the City Attorney's development of language. <br /> <br />Schaffer requested efforts be made to preserve a large tree located near the road ROW. <br />Benke explained that efforts could be made, however, there is no guarantee. <br /> <br />Proper expfained that the City would award a contract for the installation of utilities, <br />curbing, and street surfacing. Costs would be assessed against the benefitting nine lots. <br /> <br />Beach asked if Park Dedication Fees could be collected at the time the building permit is <br />issued. Teague feels alternative arrangements could be made. <br /> <br />Meilahn noted inaccuracies in the grading plan for Lot 9. Plow acknowledged those <br />inaccuracies and confirmed the higher elevations for Lot 9 will remain.
