<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />May 12, 1998 <br /> <br />Page 6 <br /> <br />Council Business. continued <br /> <br />Larson does not have issue with advertising for bids, but feels the City should not award <br />the bid until a majority of the property owners have signed the covenant, <br /> <br />Proper said Brian Olson, Civil Engineer, worked very hard in preparing a grant request <br />and legislative funding for the project, however, both efforts failed, Proposed funding <br />would come from: Ramsey County State Aide Highway Fund - 50%, City MSA Funds <br />- 5 %; and City stormwater utility funds - 45 %, The construction schedule was delayed <br />somewhat due to unanticipated time in obtaining a Rice Creek Watershed District permit <br />and Barr Engineering's workload, <br /> <br />Richard Harden, 1337 - 16th Ave, NW, does not feel the project should be conditional <br />on restrictive covenants. This issue affects the entire community being that Long Lake <br />Road is a main emergency roadway. He does not intent to damage neighboring <br />properties by adding structures or fill, but this covenant would require him to remove a <br />jungle gym in his backyard, This covenant merely red flags problems which only affect <br />a number of properties. <br /> <br />Benke said the City has no intention in requiring Harden to remove the jungle gym, The <br />covenant language states that no fill or structures be installed which could prevent or <br />reduce ponding storage. Although, it appears that current property owners are in <br />agreement it is not to say that subsequent owners may be less reasonable, and the <br />intention is to prevent problems. Harden's property currently has a drainage easement <br />which he assumes is for this very purpose, Benke explained that the City Attorney felt <br />the need to develop the covenant, but there is opportunity to modify that language. <br /> <br />Fulton noted the covenants' importance and the amount of staff time involved in <br />accomplishing this comprehensive solution. These covenants were developed through <br />meetings with affected residents and staff. <br /> <br />Proper confirmed that the bid opening is scheduled for July 14. Benke feels staff would <br />have time to resolve any details of the covenant before the bid award, <br /> <br />Motion by Samuelson, seconded by Gunderman, to APPROVE THE PLANS AND <br />SPECIFICATIONS FOR PROJECT 97-13, KARl LANE/LONG LAKE ROAD <br />RELIEF STORM SEWER; AUTHORIZE ADVERTISEMENT FOR BIDS; AND <br />REQUEST STAFF TO WORK WITH THE CITY ATTORNEY AND RESIDENTS <br />REGARDING THEIR CONCERNS OF THE COVENANT AND ITS LANGUAGE. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Announcements and Updates <br /> <br />The Healthy Youth Coalition has hired an administrative support person to handle their <br />day to day activities.
