<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />May 12, 1998 <br /> <br />Page 5 <br /> <br />Council Business, continued <br /> <br />Benke asked the procedures for public hearing notification, Kelley said notices were <br />sent to licensed tobacco sales holders, Northwest Youth and Family Services, and school <br />districts, Kelley does not recall if newspaper notices were placed. <br /> <br />Brook Schaub, PSC, confirmed that very little communication regarding the ordinance <br />was received from the grocery association or the schools, <br /> <br />Hoffman asked which fund will the administrative penalty be placed. Kelley explained <br />that currently the funds are placed in the City's General Fund, Hoffman commended the <br />Police Department and the PSC for their work on this important ordinance. <br /> <br />Motion by Gunderman, seconded by Samuelson, to HOLD AND WAIVE THE FIRST <br />READING OF AN ORDINANCE RELATING TO TOBACCO LICENSING; <br />REPLACING CHAPTER 15, ARTICLE IV OF THE NEW BRIGHTON CODE OF <br />ORDINANCES. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Samuelson and Larson thanked Kelley and the Police Department for their involvement <br />in the recent Community Police Academy. Larson feels the information presented will <br />be very helpful for those involved in the Neighborhood Crime Watch Program, Benke <br />encouraged the community to participate in this excellent program, <br /> <br />Fulton said the Plans and Specifications for Project 97-13, Kari Lane/Long Lake Road <br />Relief Storm Sewer are complete and staff is seeking authorization to advertise for bids, <br />This project was order by Council and consists of the construction of a 6O-inch relief <br />storm sewer on Long Lk. Rd, from a low point just west of Kari Ln. to the Pike Lake <br />Channel box culvert and installation of high capacity catch basins on the Pile Lake <br />Channel Box culvert. <br /> <br />Staff and residents worked to determine corrective measures to address the overall <br />drainage pattern, and the conclusion was to move forward this summer, A condition, <br />set by Council, was that residents grant restrictive covenants over the low backyard <br />areas to ensure no future filling or structures are placed in this area, This is a necessary <br />to protect low homes from local flooding. The restrictive covenants were mailed to <br />residents in February, and no responses have been received. A follow up letter was sent <br />reminding residents the signed document is required prior to the bid award. <br /> <br />Benke noted some concern of awarding the bid without receipt of the covenants, and <br />suggested deferral of the bid award until the documents are received. <br /> <br />Samuelson asked for clarification of the covenants' role, Proper said the covenants <br />prevent the possibility of a property owner applying fill in the backyard area which <br />could displace drainage and create flooding situations for nearby properties. Samuelson <br />asked if any residents responded to the May 5 letter. Proper said Ron Leaf, 1314 Kari <br />Ln" indicated no issue with the covenants and will sign the document. However, some <br />residents felt the covenants were too restrictive and may affect future home sales. <br />Proper feels some language modifications could be made.
