These lots would meet R-IA, <br />Single Family Residential standards and the existing buildings meet required setbacks, <br /> <br />There were no comments from the audience. <br /> <br />Motion by Larson, seconded by Gunderman, to CLOSE THE PUBLIC HEARING. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />Motion by Larson, seconded by Gregori, to WAIVE THE READING AND ADOPT <br />THE RESOLUTION APPROVING PL-241. <br /> <br />4 Ayes - 0 Nayes, Motion Carried, <br /> <br />Council Business <br /> <br />Economic Development Specialist Jill Bishop presented a request for quiet title and/or <br />eminent domain proceedings against Williams Pipeline. MacGillis & Gibbs granted <br />Williams' predecessor a blanket easement across the westerly third of Brighton <br />Corporate Park III (BCPIII). This interferes with development of the DonateIJe project, <br />and Williams will not release the westerly 50 ft. of the easement, <br /> <br />Sue SteinwaIJ, attorney, said to facilitate cleanup, BPA and MPCA asked Williams to <br />move the pipeline. Williams agreed, but was unable to acquire easement rights from MT <br />Properties and the railroads, Williams began condemnation and settled with Soo Line, <br />but the Courts awarded in favor of MT and Minnesota Commercial.
