Rd. reconstruction was performed <br />incorrectly because the reinforced concrete pipe (RCP) which was not installed would <br />have relieved flooding. He said the current corrugated pipe is old and retards flow. He <br />feels the project should have been performed right in the first place. <br /> <br />Proper stated that he has been accused of communicating to the County that the RCP <br />was not needed. This is not true. To assist the County in designing Long Lake Rd., he <br />provided them with a 1984 Barr report which showed the existing storm sewer and any <br />problem areas. The County came to its own conclusion of what was needed. Summer <br />rainfalls have been excessive and flooding has occurred throughout the Metro Area. <br /> <br />Motion by Benke, seconded by Samuelson, to ACCEPT THE KARl LANE AND <br />LONG LAKE ROAD FLOODING ANALYSIS AND REQUEST ADDITIONAL <br />STUDY, AND SCHEDULE A WORKSESSION ON NOVEMBER 6, 1997 , AT 4:00 <br />P.M. AT 1594 KARl LANE TO INVESTIGATE AFFECTED AREAS. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Motion by Larson, seconded by Gunderman, to RECONSIDER THE COUNCIL <br />ACTION TAKEN ON SEPTEMBER 23, 1997, REGARDING THE COURTESY <br />BUS BENCH REMOVAL SCHEDULE. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Dan Vroman, Public Policy Commission (PPC), explained that in April 1997, a resident <br />came before the PPC with concerns regarding safety, aesthetics, and other issues relating <br />to courtesy benches. A subcommittee was formed to investigate the issue, review <br />ordinances in other cities, and consider City-owned benches versus publicly provided. <br />The PPC received the report and drafted an ordinance to regulate courtesy benches. The <br />proposed ordinance provides for bench placement regulations, insures the City against <br />liability, and requires consent of the property owners adjacent to the placement. It <br />appears that the greatest need for such benches is at Metropolitan Transit bus locations. <br /> <br />Benke asked if documentation will be required if property owners agree to placement of <br />benches adjacent to or on their property. Fulton said at one time the draft included a <br />notation relating to acquiring a legal easement from the property owner, however, that <br />language was removed to allow new owners discretion for bench placement. City <br />Attorney Charlie LeFevere will draft a letter containing imperative language stating the <br />arrangement is not a legal easement. Once benches are removed from a public easement <br />and located onto private property; it raises question whether their use is legal and if <br />advertising is allowed. <br /> <br />Because the proposed ordinance does not provide for benches on private property, <br />Benke asked if this should be incorporated into the ordinance. Fulton said the ordinance <br />is structured so that public ROW benches are setback consistent with requirements. <br />Fulton feels benches on private property would be managed under the sign ordinance. <br /> <br />Larson asked if the PPC had discussions regarding private property benches.
