Benke confirmed that the registration deadline was in April, and <br />Guldan's request was received in mid-May. Guldan said he initially stopped by the FSC <br />in April to register and was told flyers will be out soon and to sign up later. Guldan <br />never received the flyer, and in mid-May was told it was too late and the program was <br />filled. Benke said deadlines are necessary to develop rosters, schedules and order <br />uniforms. Larson said the Parks Department sent flyers to schools on February 20. <br />Registration began March 4, and was extended to April 20. Guldan said those who are <br />not in public school do not receive notice of registration. <br /> <br />Benke read a statement from Guldan's letter that "it is the intent of Bird Dog and <br />Retriever News to take this matter to the court system if this project continues." Benke <br />asked Guldan if he was willing to post bond to cover the increased costs of performing <br />environmental studies and any project delays if those studies were found to be <br />unnecessary. Benke asked who Guldan would hire to perform these studies. Guldan <br />has not been approached with the project figures and would need to further research. <br /> <br />Fulton asked which wildlife officials have Guldan been in contact. Guldan contacted the <br />U.S. Fish and Wildlife Service; Greg Downing of the Environmental Quality Board; and <br />DNR Wildlife Division. Benke asked if Guldan is willing to resubmit the petition to <br />allow signees to review current data. Guldan requested current data to circulate. <br /> <br />Guldan reiterated the need for an environmental impact analysis, and asked why a DNR <br />permit was not required. Anderson reviewed a letter from the DNR stating the floating <br />boardwalk does not require a DNR Protected Water Permit because the structure is not <br />permanently anchored by foundation and the structure does not constitute a hazard. <br />Guldan requested a copy of this letter. Samuelson questioned the signatures from Bethel <br />College students. Guldan noted that if these signatures were eliminated, the petition still <br />has the required 24 signatures. <br /> <br />Anderson recently spoke to representatives from the U.S. Fish and Wildlife Service and <br />Rice Creek Watershed District (RCWD) regarding the use of another FSC marsh area as <br />replacement to damage created by MacGillis and Gibbs pollution. Both agencies <br />expressed interest in raising the water level in the easterly portion of the marsh area (not <br />the boardwalk area) to make it more attractive to migratory waterfowl. A weir in this <br />easterly portion constructed many years ago by the RCWD has deteriorated and is not <br />functioning properly. Anderson reviewed the walking path project with both <br />representatives, and neither expressed concerns. Anderson said Audrey Molari of the <br />DNR division overseeing grant requests does not see reason for further review. <br /> <br />Benke requested Guldan bring a revised petition to the June 4 meeting so persons <br />interested can sign the revision. He prefers individuals be given all the facts in order to <br />decide whether to sign a petition, and asked Fulton to compile a summary and mail to <br />those listed on the original petition.
