FROM THE STREET <br />SIDEYARD PROPERTY LINE OR THE WALNUT AVE. NW RIGHT-OF-WAY <br />LINE, ON PROPERTY LOCATED AT 2313 WALNUT COURT NORTH. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />City Manager Matthew Fulton presented the Bias/Hate Incident Response Plan. The <br />plan was presented in April, and Council requested modifications to the last paragraph. <br />The PSC Human Rights Subcommittee reviewed the changes and endorsed the plan. <br />The following changes were made to the last paragraph: "Each incident and the response <br />action taken shall be reported to the City Council within 10 days of the initial report. It <br />shall be the responsibility of the City Manager, with consultation with the Mayor, to <br />designate a spokesperson for the City; if the situation so warrants." <br /> <br />Williams said the first paragraph reflects the need for in-person contact with the victim. <br /> <br />Motion by Samuelson, seconded by Williams, to ADOPT AS THE CITY'S OFFICIAL <br />BIAS/HA TE INCIDENT RESPONSE PLAN WHICH WAS DEVELOPED BY THE <br />HUMAN RIGHTS SUBCOMMITTEE OF THE PUBLIC SAFETY COMMISSION. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Locke presented a covenant not to sue in regards to the redevelopment of the MacGillis <br />and Gibbs poleyards and SuperFund site, 440 - 5th Ave. NW. <br /> <br />On April 22, Council authorized use of eminent domain to acquire the property. The <br />property carries certain potential liabilities for future owners, and millions of dollars will <br />be spent before contamination cleanup is complete. The City must protect itself and <br />future owners from responsibility for existing or future environmental clean up costs and <br />liens. This documentation between the City, U. S. Environmental Protection Agency, <br />and Minnesota Pollution Control Agency is critical for redevelopment. Issues of access <br />and site use are addressed through placement of easements and restrictive use covenants. <br />Because site conditions vary, the property has been split into three different zones, each <br />with its own set of requirements. <br /> <br />Sue Steinwall, Fredrickson and Byron, said the agreement illustrates Federal and State <br />government's willingness to enter into an agreement so to put contaminated properties <br />back to good use. Some cleanup work has begun, but the bulk will be performed mid- <br />summer. Ramsey County will need to address the delinquent property taxes. <br /> <br />Motion by Larson, seconded by Samuelson, to APPROVE AND AUTHORIZE <br />EXECUTION OF THE AGREEMENT AND COVENANT NOT TO SUE AMONG <br />THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY, <br />MINNESOTA POLLUTION CONTROL AGENCY, AND THE CITY OF NEW <br />BRIGHTON IN SUBSTANTIALLY THE FORM ATTACHED. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />Walnut Court Garage <br />Addition <br />Report 97-106 <br /> <br />Bias/Hate Response <br />Plan <br />Report 97-107 <br /> <br />Mac Gillis and Gibbs <br />Covenant to not to <br />Litigate <br />Report 97-108 <br />
