The City owns and <br />operates numerous public facilities and properties. This ordinance provides the <br />methodology which the City would have legal ability to adequately respond to the <br />behavior of individuals at any public property as well as with those participating in <br />municipal activities. In working through a recent issue, it was discovered that a formal <br />ordinance to provide the terms and conditions to effectively manage properties was <br />needed. <br /> <br />Williams noted that paragraph D should be strengthened to read: "It is unlawful for a <br />person to remain on the premises of public property after demand is given that such <br />person leave by the Manager or the Manager's designee or to return to such premises <br />after having been directed to leave without first having obtained permission by the <br />Manager or Manager's designee to reenter upon such premises." <br /> <br />Samuelson verified these rules are not currently in any City ordinance, and asked if this <br />ordinance was modeled after another. LeFevere said paragraphs A, B, and Care <br />primarily from State Statutes, and the majority of language from paragraphs C, D, and E <br />provides for enforcement. <br /> <br />Larson confirmed that the ordinance will be posted in all City facilities. <br /> <br />LeFevere said the ordinance will cover a specific set of circumstances, and over time <br />will be expanded to cover consumption of food and beverages, smoking, music, access <br />to restricted areas, and other incidences. If someone wanted to appeal the decision, they <br />would go through the court process. Benke asked if there would be an intermediate <br />appeal process. LeFevere said it is similar to the union grievance process where the <br />Manager would provide final decision, but may request Council and legal opinion. <br /> <br />Benke said the new State Stalking Law was recently signed by the Governor, and noted <br />that the word "Stalking" appears in the Rules of Conduct on City Property. Williams <br />added that the ordinance is effective regardless of State law. <br /> <br />Motion by Williams, seconded by Samuelson, to WAIVE THE FIRST AND SECOND <br />READING AND ADOPT AN ORDINANCE AMENDING CITY CODE, SECTION <br />18 BY ADDING SECTION 18-5.5 PROVIDING FOR THE USE OF PUBLIC <br />PROPERTY. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Fulton presented potential Public Policy Commission (PPC) topics. PPC has identified <br />the following topics for research: mediation services, public safety education, municipal <br />ordinances, utility rates, post office, municipal service, budget, election debates, <br />community survey, housing/apartment issues, citizen engagement, sustainable <br />communities, performance measures, quality of community, and bus shelters. <br /> <br />Samuelson questioned whether public safety education could be a collaborative project <br />with PSC and PPC, and feels the PPC should be given vital issues to focus upon. <br /> <br />Council Business <br /> <br />Use of Public Property <br />Report 97-109 <br />Ordinance 631 <br /> <br />PPC Topics <br />Report 97-110 <br />
