<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />February 25, 1997 <br /> <br />Page 6 <br /> <br />Council Business. continued <br /> <br />Motion by Gunderman, seconded by Williams, to WAIVE THE READING AND <br />ADOPT THE RESOLUTIONS APPROVING SP-197 AND PL-231. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Kelley presented the revisions to the animal control ordinance. <br /> <br />At the first reading of the ordinance, Council directed staff to further clarify the <br />notification process which involves the citizen notify the animal owner whose dog/cat <br />has been running at large before the City issues a citation. Council felt that some <br />individuals may feel uncomfortable in confronting their neighbor. Because of this, the <br />wording was changed to: "or someone acting on their behalf." The following changes <br />were also made: definition of "restrained" was developed to clarify what control a <br />dog/cat owner must have over their pets on the unfenced property; the eight-foot leash <br />restriction for dogs/cats in public places was deleted; and animal must be effectively <br />chained or leased was added. <br /> <br />Williams thanked staff for making those changes to the ordinance. <br /> <br />Motion by Williams, seconded by Samuelson, to HOLD AND WAIVE THE SECOND <br />READING OF AN ORDINANCE AMENDING CHAPTER 6, ANIMALS AND <br />FOWL, OF THE CITY CODE. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Williams explained that for the last three years, the City received several peddler license <br />requests for individuals doing business for Edward Jones, Inc. He takes issue with a <br />solicitation approach which knocks on doors to solicit the sale of financial instruments <br />and provide literature for office locations. He does not believe the applicants have any <br />intention in opening an office in New Brighton. <br /> <br />Samuelson asked if this is the applicant's first request. Kelley explained that the <br />previous applicant has now moved to Forest Lake; and the staff recommendation does <br />not note the "selling of investments door to door." <br /> <br />Motion by Williams, seconded by Larson, to DENY A PEDDLER'S LICENSE TO <br />TODD JACOBSON, DOING BUSINESS FOR EDWARD JONES. INC. <br /> <br />No Vote Taken. <br /> <br />Fulton said the denial of the application may present legal concerns. Williams stated that <br />if the applicant attended the next meeting and presented a signed office lease, he would <br />change his motion. <br /> <br />LeFevere explained that one problem with the ordinance is there are no standards for <br />denial unless the applicant demonstrates immoral character.
