<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />May 28, 1996 <br /> <br />Page 3 <br /> <br />Council Business. continued <br /> <br />Motion by Gunderman, seconded by Benke, to APPROVE THE PUBLIC POLICY <br />COMMISSION RECOMMENDATION FOR A STUDENT ELECTION ISSUES <br />FOCUS PROGRAM. <br /> <br />4 Ayes - 0 Nayes, Motion Carried. <br /> <br />City Planner Erny Mattila presented a simple plat to resubdivide two existing oversized <br />two family lots into four two-family residential lots. The properties are located at 2780- <br />2782 Mississippi St. In the past, the City approved small subdivisions or resubdivisions <br />as simple plats. A simple plat can be approved when a subdivision is small and the <br />applicant wants a lot-block legal description versus a metes and bounds description. <br /> <br />The proposal is located on a large residential block containing single and two family <br />homes while the middle of the block remains open with large backyards. The block <br />comprises three newer subdivisions and a section of older platted land where the two lot'l <br />are located. The older subdivision contains single and two family homes on large <br />rectangular lots. The front portions of the single family lots are zoned R-l, and the back <br />portions R-2. The City may had anticipated development of the backyards for two family <br />homes, yet no 60 ft. section was dedicated for right-of-way (ROW). Not being placed <br />on ROWS is unusual for lots, but private roads have been allowed for subdivisioI1'l <br /> <br />The applicant proposes a 24 ft. private drive off Mississippi St., and access easement <br />along the center property line of the two existing lots because a 60 ft. ROW will not fit <br />between the existing homes. The City Engineer has no problem with the private access, <br />however, Ramsey County needs to approve the curbcut. A grading and drainage plan <br />would be required. The Fire Marshal requires a driveway turnaround and fire hydrant <br />behind the existing two family homes. The Planning Commission recommended denial. <br />At this time, the applicant has requested continuation at a future date. <br /> <br />Benke asked the reaSOI1'l for Planning Commission denial. Mattila summarized reasons <br />for denial: does not allow for a lot's widest section to front a public ROW; subdivision <br />does not accommodate a public ROW or allow compliance with setback standards; no 60 <br />ft. wide strip of land or public ROW established off any adjacent street leading to the <br />open area to allow for future public street or development of open area; and open area <br />has potential for additional driveways causing traffic safety concerns on Mississippi St. <br />Benke noted several lots to the north with similar backyard areas, and questioned if <br />Council would be in a dift1cult position to decline similar plans if this proposal were <br />approved. He understands the applicant's concern to continue the item, and noted many <br />older lots now appear oversized by today's standards. He also understands resident <br />concerns and will allow comment, but reiterated Council will not take action tonight. <br /> <br />Barry Brottlund, applicant, said the continuation is requested in order to gather <br />information on criteria set forth by the City, and allow time to meet with residents. <br /> <br />Tony Peraddi, resident, said Brottlund presented an alternate plan involving three triple <br />car garages facing his property. He is unhappy about the plans, and feels the road <br />would allow for more duplexes being built. Benke said alternate plans need to be <br />reviewed, and Council and staff will work to find a mutual solution, if possible. <br />Gunderman asked when Peraddi received the new plan. Peraddi said Brottlund <br />delivered the new plan at 8:30 a.m., Saturday. Peraddi is concerned that the proposal <br />will decrease his property's value.
