<br />I <br /> <br />I <br /> <br />I <br /> <br />Council Meeting Minutes <br />April 23, 1996 <br /> <br />Page 6 <br /> <br />Public Hearinl!. continued <br /> <br />Hearing was closed at 9:05 p.m. <br /> <br />Motion by Williams, seconded by Gunderman, to WAIVE THE READINGS AND <br />ADOPT THE RESOLUTIONS: AUTHORIZING CREATION OF TIF DISTRICT <br />#25; AND, THE DECERTIFICATION OF TIF DISTRICTS #21 AND #22. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Council Business <br /> <br />Locke presented property acquisitions by eminent domain. This action insures acquiring <br />of properties needed for the Lakeview Business Project located in TIF #25, and resolves <br />differences in fair market value. The Brost property has been acquired, but this action <br />involves Plocienik and Day properties, and the east end of the Pletscher property. <br />Discussions have been held with the owners, and the appraisals are almost complete. <br /> <br />Williams, who originally requested the item be delayed, is satisfied that negotiations are <br />taking place and is comfortable with the staff recommendation. <br /> <br />Dorothy Plocienik, 577 Old Hwy 8, requested review of her property's appraisal which <br />was performed by the City's consultant. Benke acknowledged that Council has not <br />reviewed the appraisals yet, but will relate her request to staff. <br /> <br />Brian Pletscher, 631 Old Hwy 8, requested clarification of the access to his property. <br />Locke said the proposed location of Campus Dr. was surveyed and discussions are <br />underway. Larson asked if Pletscher will require curbcuts off Campus Dr. and the east. <br />Locke said a southerly access is attainable, but an easterly access needs research. <br />Pletscher noted grading and alignment issues associated with an easterly access. Benke <br />requested investigation of Pletcher's concerns, and feels the City should acquire only <br />minimal property needed for Campus Dr. Locke will investigate. <br /> <br />Motion by Larson, seconded by Samuelson, to WAIVE THE READING AND <br />ADOPT THE RESOLUTION AUTHORIZING ACQUISITION OF THE <br />PROPERTIES IN TIF #25 BY EMINENT DOMAIN PURSUANT MINNESOTA <br />STATUES SECTION 117.042 RESPECTIVE DEVELOPMENT NO.1. <br /> <br />5 Ayes - 0 Nayes, Motion Carried. <br /> <br />Park and Recreation Director Maurie Anderson presented the pathway extension at <br />Innsbruck Park to Bent Tree Hills Dr. Two years ago, staff and Park Board <br />recommended the pathway extension, but found opposition by residents who felt the <br />pathway would increase vandalism, reduce privacy, and decrease property values. The <br />Board felt these reasons were outweighed by the need to provide off street access to the <br />park. Council then deferred action. On April 3, a neighborhood meeting was held, and <br />only one person spoke in guarded opposition. The extension is now recommended. <br /> <br />Gunderman said the Harstad Company has not completed drainage work associated with <br />the park's retention pond. Anderson said Proper has been in daily contact with Harstad, <br />but no defmite word ha.'l come regarding completion. Gunderman noted impatience that <br />the situation has not been remedied, and asked if legal action should be pursued.
