I I I Council Meeting Minutes April 23, 1996 Page 6 Public Hearinl!. continued Hearing was closed at 9:05 p.m. Motion by Williams, seconded by Gunderman, to WAIVE THE READINGS AND ADOPT THE RESOLUTIONS: AUTHORIZING CREATION OF TIF DISTRICT #25; AND, THE DECERTIFICATION OF TIF DISTRICTS #21 AND #22. 5 Ayes - 0 Nayes, Motion Carried. Council Business Locke presented property acquisitions by eminent domain. This action insures acquiring of properties needed for the Lakeview Business Project located in TIF #25, and resolves differences in fair market value. The Brost property has been acquired, but this action involves Plocienik and Day properties, and the east end of the Pletscher property. Discussions have been held with the owners, and the appraisals are almost complete. Williams, who originally requested the item be delayed, is satisfied that negotiations are taking place and is comfortable with the staff recommendation. Dorothy Plocienik, 577 Old Hwy 8, requested review of her property's appraisal which was performed by the City's consultant. Benke acknowledged that Council has not reviewed the appraisals yet, but will relate her request to staff. Brian Pletscher, 631 Old Hwy 8, requested clarification of the access to his property. Locke said the proposed location of Campus Dr. was surveyed and discussions are underway. Larson asked if Pletscher will require curbcuts off Campus Dr. and the east. Locke said a southerly access is attainable, but an easterly access needs research. Pletscher noted grading and alignment issues associated with an easterly access. Benke requested investigation of Pletcher's concerns, and feels the City should acquire only minimal property needed for Campus Dr. Locke will investigate. Motion by Larson, seconded by Samuelson, to WAIVE THE READING AND ADOPT THE RESOLUTION AUTHORIZING ACQUISITION OF THE PROPERTIES IN TIF #25 BY EMINENT DOMAIN PURSUANT MINNESOTA STATUES SECTION 117.042 RESPECTIVE DEVELOPMENT NO.1. 5 Ayes - 0 Nayes, Motion Carried. Park and Recreation Director Maurie Anderson presented the pathway extension at Innsbruck Park to Bent Tree Hills Dr. Two years ago, staff and Park Board recommended the pathway extension, but found opposition by residents who felt the pathway would increase vandalism, reduce privacy, and decrease property values. The Board felt these reasons were outweighed by the need to provide off street access to the park. Council then deferred action. On April 3, a neighborhood meeting was held, and only one person spoke in guarded opposition. The extension is now recommended. Gunderman said the Harstad Company has not completed drainage work associated with the park's retention pond. Anderson said Proper has been in daily contact with Harstad, but no defmite word ha.'l come regarding completion. Gunderman noted impatience that the situation has not been remedied, and asked if legal action should be pursued. He feels this inconvenience is unfair to the City and residents.
